What Bahvest did was nothing but just to buy time to delay the payment of the compensation of RM 20m ( of which RM 6m has been paid ) . The eventuality is expected to be the same..... Pay up what is owed. If due signed document at mutual agreement is subject to be challenged all the times, then what is the use of execution of the contractual agreement without secured protection and abiding ?

It is preposterous for Bahvest to be owned by Bank Negara, the Government will never do that in a million year for a simple reason that Gold mining often has adverse environmental impacts, such as deforestation, water pollution, and habitat destruction. Social concerns related to the displacement of local communities, human rights violations, and conflicts etc .
Instead of ownership, the Governments and regulatory bodies will increasingly toughen responsible mining practices and impose various environmental regulation on mining operations, which can increase operational costs, higher compliance costs and impact the profitability gold mining.
The Government would not step in the gold mining. To do so, it is akin to stepping its own foot into the grave.

In the view of the legal team, Bahvest is only buying time and futile to recover the amount of RM 6m which is part of the compensation sum of RM 20m for trespassing the land where the factory was erected. Bahvest has failed to pay the amount of RM 7 m which is part of the non refundable deposit of RM 13m as agreed. Legal document to that effect has been duly executed and there is no basis for the new management and party to challenge the due resolution and process conducted in a legal manner.
Bahvest as a lessee has already publicly admitted and acknowledged that they have been violating the term since inception. Hence, there is no legal basis of annulling the demand initiated by the Lessor ( Southsea). The recent incident of sabotaging the factory was believed to be motivated by the new management themselves to give wrong impression to the public that it was the making of the previous administration. The recent surge was believed to be internally motivated by the new management too in disguise to avoid the slump in the share price but of no avail, most investors including retailers have already sidelined this counter for goodness sake.

The reader has been misled by the points on the articles /posts posted by someone here.
So far there is no existence of concession agreement in Bahvest but merely sublease agreements between the Bahvest and Southsea and wuller. There are clear distinctions between Concession agreement and Sublease agreements.
In a concession agreement, the parties involved are the government or public body and the private company who is controlled by DL and proxy of the influential force. In a sublease agreement, the parties involved are the original lessee, the sublessee, and the landlord. It is clear that the Landlord is Southsea and the subleasee is Barhvest. The Concession agreement is out of the picture in Bahvest
A concession agreement grants the private company the right to operate a business or provide a service within a specified area or facility. A sublease agreement grants the sublessee the right to occupy and use all or part of the leased premises. Bahvest as a sublessee must abide by the terms of the sublease agreement. Bahvest has violated the terms by sitting on the trespassed land for its factory etc
In a concession agreement, the private company is typically responsible for all aspects of the business, including operations, maintenance, and investment. In a sublease agreement, the original lessee remains responsible for fulfilling all obligations under the original lease agreement, while the sublessee is responsible for paying rent to the original lessee. Has sublessee fulfilled its responsibility of paying the rent . The compensation of RM 20m++ is basically the accrued rent on the trespassed land based on the market rental
In a concession agreement, the private company usually pays a fee or percentage of its revenue to the government or public body. In a sublease agreement, the sublessee pays rent to the original lessee, who is responsible for paying rent to the landlord. The concession agreement is said to be between DL and the Government and nothing to do with Bahvest. It is believed that DL through his company has regularly paid the royalty to the Government based on the output yield extracted from the said land.

To enter into further negotiation , full deposit of RM 13 M must be paid as a prerequisite condition. Any shortfall or partial payment will jeopardise the nego. RM 6 M is still falling short of RM 13M. RM 7 M must be paid before any nego process can be proceeded otherwise more lawsuits will be entertained.

Those counter claims are subject to be challenged to be determined by the court at the later stage , which could not be used to offset against the confirmed compensation of RM 7 M . Bahvest must pay 1st before the counter claims are to be heard at different intervals.

Even before the extraction operation starts , the cash stricken Bahvest is required to pay compensation of RM 7 million to southsea , failing which complete shutdown of operation is expected. There is a deadline for injunction. DL is expected to wait till 17th July .It is expected that the said injunction will not be extended following which DL will whack Bahvest hard .

Due to the negative news today, there has been no movement of internal selling or buying activities since morning .Hence it can be inferred that the demand and supply of this counter shares are internally self- motivated without active participation of other retailers and other investors. Injunction is futile. When Bahvest is sitting on the trespassed , they are already found to be guilty. Sublease agreement spells out very loud and clear the right of lessor and lessee. Either both AAX and Cap A exit PN 17 together or die together. No such thing as one to exit PN 17 while the other remains in PN17. Though there are separate entities, they are associated to each other like brother and sister. do or die together , no choice for both shareholders.

In the absence of serious contenders to challenge AirAsia as a budget airline, AA is still in a position to make big money which is beyond the point here. How to resolve the the mounting debt of RM 18b++ of Cap A is the crux of the problem. It is believed that AAX has no problem to lift the PN 17 , however , AAX can not see the sister company to remain in PN 17 . AAX would try to assist Cap A one way or the other. Hence ,the shareholders of AAX must sacrifice for the sake of Cap A knowing that these two companies ( AAX and Cap A ) compliment each other in operation or otherwise.

t is a wrong perception that companies with high share prices have no room for appreciation or have reached their peaks. Company like Nestle is a world class brand with ever increasing demand for its consumers products Despite its MV of RM 131 per share, its NOSC remains as low as 245m shares . It is believed Nestle is not prepared to lower its shares through Bonus issues but cash dividend as a reward to its loyal investors. It is believed that Nestle will continue to keep its share price as high as possible without lowering it through bonus issues for the following reasons:-
1.A higher share price provides a cushion against potential takeovers or hostile acquisition ttempts. It makes it more expensive for a would-be acquirer to purchase a controlling stake in the company, serving as a deterrent in hostile takeover situations
2.A high share price can improve the company's reputation and image in the market. It signals that the company is well-managed, profitable, and reliable, increasing investor confidence and attracting potential customers, partners, and employees.
3.A high share price is often seen as a sign of success and attracts potential investors. It creates a positive perception about the company's financial health and growth prospects, increasing the likelihood of investment.
4. A higher share price can give the perception of stability and value, making the company's stock less volatile. It can attract “ long-term” and “ serious “ investors who prefer stable investments and are willing to pay a premium for shares of such companies. There is no room for speculators in Nestle unlike in Bahvest where majority of them are speculators and where the share price is so volatile that it can be plunged from one level to the another level within a day without significant news and otherwise. Such movements are believed to be motivated by the Market operator ie Inno.

The reason why Nestle share can appreciate to great extent over the years is because it is engaged in production of consumers' products meeting the needs of the spectrum of consumers unlike good mining.

It is believed that the FL and new management are not prepared to hold more than 10 % of shareholding in total due to the following reasons:-
1. Inconsistent demand in both domestic and international markets, making it less stable and reliable business as compared to FL's palm oil business and the value of gold often fluctuates, making it a more volatile market.
2. The remaining lease term of the said gold mine is said to last another 15 years if not lesser. The lease on the trespassed land where the factory is erected has yet to be resolved . Furthermore , the said Gold mines have limited resources where once the gold ( hopefully no fool's gold ) is extracted, the operation becomes economically unviable.
3. Higher investment and operating costs vs uncertain output yields. The profitability is uncertain from one QR to another QR. The revenue could be easily outweighed by the high operating costs due to the uncertainty of the output yields underneath. That's why the ex-CEO kept on giving " excuse for the loss and /or in insufficient profit " by claiming that excavation was not done deep enough where there were tons and tons of gold underneath to be unearthed. How deep is deep? Nobody knows.
On the above basis, how far the company can go remains to be doubtful but someone here has claimed that it could go beyond 2.50 which is insane of the highest order. Maybe he said this in his fantasy.

It is believed that the sudden surge yesterday despite of the negative news of disturbance on the gold mining factory was motivated internally on purpose by the new mgt.This was to avoid the share price from being depressed again for you to buy cheap again( following the previous plummet).

When both parties have signed the agreement in good faith and they must abide by the terms of the agreements. What the new management is doing is to waster the court's time , resources and taxpayer's money and also deplete the resources ie cash and otherwise of the company. They have taken the court for granted and it is futile for them to proceed.
