As said earlier, most of the corporate figures in Sabah are said to be embedded with the feudalistic culture. DL is of no exception where he is protected with a formidable force from behind .Thats why he has been untouchable for all these years. The manoeuvre of 100kg of gold is a piece of cake to him.

It is purportedly believed that DL did not declare about 100kg of gold worth RM25 million for a reason. It is said that the 100kg of gold does not belong to Bahvest in the first place.

It is believed that DL just “Borrowed “” it from other sources with the agenda to boost Revenue/profitability in one of the QR. Whether the said 100k of gold was already reported as sales revenue or not remains to be verified. If the said 100kg has been reported in one of the QR, then the question of non- payment of royalties does not exist. However, such an act would constitute a “ false accounting ” issue like Serba Dynamic ( SD ).

In the case of SD, false accounting has been established as a result of which the MD, Dr.K and his gang were compounded by SC with the hefty fine without imprisonment term. Hence in the case of Bahvest, DL would most be likely to face with the same. DL can still afford to pay and no cause of concern.

It is learnt that DL agrees to back off by selling his entire shares and by not seeking to sit in the board on the conditions that all the charges against him and his gangs be dropped.Nothing more nothing less.

If two or more companies to take off and /or rebound,he stands to gain handsomely.

Though its rewarding , the holding times could be longer than expected at the expense of opportunity costs.Again ,if the opportunity costs are outweighed by the rewarding gain,its still worth your while to hold....hope not till you become half past six...

Neither would FL and gang be appointed to BOD.A third party is expected to be emerged as intermediary between the two camps..

Change of tactics following the disposal of entire shareholding of DL today under instruction.DL is no longer a shareholder of bahvest and is expected not to seek appointment of directorship in the upcoming EGM under instruction.

DL is an incumbent and there is no need for him to show up unlike FL camp who need to show up to lobby the last minutes supports. But it is of no avail, the game is already set whereby the majority of shareholders( nominees or otherwise) have already been directed accordingly. The place of the EGM is irrelevant.

It is also believed the recent issuance of the lawsuit on trespassing was not initiated by DL but someone who is too powerful to be true. DL would not have the audacity to proceed with such an action without the consent from this Master form behind . Generally,there is no requirement for a shareholder to hold a certain number of shares before he or she can be eligible for appointment as the CEO of a Berhad. Shareholders may be appointed as CEO through various means, such as being nominated by the board of directors or by other shareholders. As long as DL has secured the substantial supports from other shareholders particularly the major shareholders,DL will survive.

DLis still a shareholder though not significant , may still provide some advantages when it comes to appointment as a CEO. His commitment to the business is unequivocal.

Ultimately, the decision to appoint a CEO is based on the best interests of the company and its shareholders. It is believed that a big gun is in support of DL

One thing for sure and no matter what the eventualities are, Bahvest will never fall into the hands of WM in a million years.

The verdict of the Court today has made it very clear that there is nothing wrong with the ROD used by DL for the proposal of the upcoming EGM. The challenge of FL and gangs is never tenable.

Apparently FL has the tendency to resort to " Backdoor " . Kretam is used as a "Backdoor listing" for his palm oil plantation empire through which he can quickly gain access to public capital markets, bypass the lengthy IPO process, or take advantage of the existing infrastructure and shareholder base of the Berhad .

Similarly for this time round, he is expected to penetrate into the directorship of Bahvest through " backdoor" again like a backside boy unlike DL.

Imprisonment is served only upon being proven to be guilty. DL is not even proven to be guilty yet. FL has yet to be successfully appointed on board. Anything could happen anytime from now. If the outdated ROD is found to be invalid by the Court,the scheduled EGM on 13/06 is expected to be postponed.

It is believed that the updated ROD is favourable to FL camp but then the recent purchase in bulk through nominees is in favour of which camp remains to be seen

It is learnt that DL is still in possession of 40 m shares. He is still a shareholder and still up to the fight to retain his directorship in the upcoming EGM.

It is believed that FL and gangs holding 10% in total for a reason and are trying their luck to take control of Bahvest. FL , having the corporate experience with Kretam , wants to show off that he is still living legend in his local community there in Tawau. Unlike Kretam where FL holds directly and indirectly more than 50%, his shareholding in Bahvest is completely opposite . Perhaps he is up to something ........ good or bad or ugly? .... DL will be released today and walk free. It is believed that he will carry out vengeance fast and furious. Drama has just started....

FL and gangs are expected to be appointed to helm the company . It is believed that they will show to the world that they can outperform their predecessors ( DL and gangs ) with better results and performance in years to come.

It is believed that the new management ( FL & gangs ) will ensure that the Company will be reporting profit quarter in and quarter out " by hook or by crook" whereby the wealth of the shareholders is assured from the reflection of the appreciation of share price. How this " assurance" is guaranteed is simple . If the QR is not attained as expected , the results can be " enhanced " ( if you like , you may it " manipulated " ) by adding more gold deposits from the unknown sources to boost the output yields thereby enhancing the sale revenue and profitability.

No one can be sure of the output yield from the mine and it is up to FL and gangs to determine as they wish in their whims and fancies. As highlighted earlier, if the ultimate objective of having "capital gain " through the appreciation of the share price outweigh the " cost of injection of gold deposit" , it is worth their while to adopt the " by hook or by crook approach " where all the shareholders are happy in the end and the new management can secure their BOD unchallenged. Its a Fxxking win win situation.

Basically, gold mining is the easiest and simplest way of fooling shareholders with the yields of your fantasied creation. As long as the gains from the share value outweigh the " cost of injection of gold deposit ( ore)", it is a monkey business.

Yer, All FL wants is to sit on BOD and pledges with the shareholders that he would dig deeper and deeper to retrieve more and more gold deposits . When the QR is constantly reported to be profitable , the share price would be double.

If there is no enough gold deposit to boost the profitability, FL could somehow inject the gold deposit through his own magic to boost the profitability. No one knows what the yield of output from the soil anyway . FL can say whatever yield as he likes .

Why should FL trigger the mandatory takeover where FL is required to offer to all the shareholders at an agreed price which would cost him more ? If some shareholders do not agree to the price offered by him, he may get stuck . Furthermore, there is no need for him to buy the whole damned company to gain control. Secondly , given that the remaining lease of 17 years to go, it is unwise to go for this move.

Many of you firmly believe that the share price is correlated to the exclusiveness of DL in that the share price would be spiked when DL is no longer in charge as if DL was the sole and exclusive culprit to the current misfortune of Bahvest.

Secondly, many of you are highly delusional in that the future prospect would be better under the charge of new management upon departure of DL.

From the reflection of the current share price, the market has different perspectives until then the share price is expected to be stagnant if not depressed further

Why is there still lack of enthusiastic support and/or purchase of the share despite that " Gold digger King" has been held for interrogation of the allegedly irregularities ? I thought I saw " James bond" lurking around here. Even now the Foreign Secret Agent like 007 is involved . WTH

If DL is found to be involved in ML , then he could be charged under ANTI-MONEY LAUNDERING AND. ANTI-TERRORISM FINANCING ACT 2001.

You are protected by " disclaimer clause" . The investors cant be so dumb to believe what is said be it here or otherwise . They should be discerning enough to form their final decision makings with their sense of sound judgements.

It is believed that the legal team must have looked into the possibility of termination of the sublease to Wullersdorf Resources Sdn Bhd and directly award of the sublease to Bahvest. Unless Wullersdorf is found to be in breach of terms and conditions , it is believed that it is difficult to do so as it is subject to be challenged in Court , which is time consuming.

The direct award of the adjacent gold mine ( land ) to bahvest could be workable coupled with the " New Factory " ( assuming the new management has given up the idea of using the old factory ), The move is expected to take considerable times whereby production is definitely and temporarily put to a halt.

Nevertheless, based on the above measures, the share price is expected to be in hibernation for a long time until the production is commenced.

That shows that the market is as sceptical as anyone else as to the capacities and capabilities of the new management should they be voted in to take control of the management of Bahvest. The outcome of the trespassing lawsuit is still uncertain. This recent provocation of the FL camp to DL will jeopardise the negotiation with the Landlord for a deal ie agreement to use the factory at a token rental.

Judging from the recent raid and harassment of DL, he is unlikely to negotiate but enforce his right as a landlord to vacate the factory on the encroached land, forcing the production of Bahvest to a halt. If this is the likely outcome, there is no room of celebration for the market as to the future prospect of the company which is viewed to be doomed.

Whether shit or not , the share price shows it all .... no positive reaction. That can only tell you one thing.............got it ?

It was commented by someone that the Market could not react positively in response to the so called piece of "good news " which was released late yesterday. Given the publicly known information since this very morning, the Market doesnt react positively to it whereas the share price remains stagnant if not depressed further....

Who is in breach ? MACC and SC have yet to publicly announce that DL and or BOD have been in beach.

All is confirmed is that Bahvest has been in breach of trespassing of its factory. From the reflection of the share price, the so called " good news" as claimed by many has not been well- acknowledged by the market. This shows that this is definitely not a piece of good news as claimed.

Whether you like it or not , the lawsuit will proceed and the encroachment in private land is still valid. DL is set to be richer by RM 300k per month if the new management wish to continue to operate the Factory.

His compensation of RM 20M++ is more than enough to cover the shortfall if only proven to be guilty. No big deal.

The fellow is detained until 19th May ( this Friday) .Whether he will be charged or not remains to be seen. Nevertheless , As at to date, he is innocent until proven to be guilty by the Court. We'll wait and see.

The moment of truth will be known at 9.00AM whether the recent news is receptive to the market or not be it market makers or otherwise from the reflection of share price . if it is positive, then someone wins the jackpot.If it is negative, someone bites the dust.
