Doubt Ongkili is willing to force through the deal given election sensitivity. If so, Gamuda will be in trouble reporting its coming quarter reports while PKR's Azmin will cry claiming that BN's federal cares nothing about Rakyat but cronies. But guess we will benefit given that Puncak has agreed to all terms set out by the federal...

KUALA LUMPUR: The Selangor government has up to April 30 to respond to the extension of the cut-off date for the Master Agreement on the Selangor water supply industry restructuring, said Energy, Green, Technology and Water Minister Maximus Ongkili today.

Failing this, he said, the Federal Government would take the view that the Selangor government was not interested to take up the offer on the restructuring exercise and complete takeover of the concessionaires in Selangor as contained in the Master Agreement.

He said after the deadline, the Federal Government would take the necessary action required under the Water Services Industry Act 2008 (WSIA) and other relevant laws to ensure the national interests and welfare of the people were protected.

“To ensure the security of water supply and completion of all planned projects including mitigation measures, we are hopeful that the spirit of cooperation as upheld by the Selangor Government in the past will continue to prevail,” he said after visiting the Langat 2 Water Treatment Plant in Hulu Langat near here.

Ongkili said the cut-off date for the Master Agreement had been extended twice as it lapsed on March 9 but the Selangor government did not agree to extend it further to complete the Master Agreement’s implementation.

“I have even personally written to Selangor Menteri Besar Azmin Ali on March 12 asking him to rethink his decision not to extend the cut­-off date of the Master Agreement as well as on outstanding matters that need to be resolved. However to date, I have not received a formal reply from the Menteri Besar,” he said.

Ongkili said the Federal Government valued very much the royal address by the Sultan of Selangor, Sultan Sharafuddin Idris Shah at the opening of the state legislative assembly sitting on March 30, in which he expressed concern on the impact of all the delays and politicking to the lives of people of Selangor, Kuala Lumpur and Putrajaya as well as on business.

“We hope the Selangor Government will take heed of His Highness’ advice that the Master Agreement is implemented fully and to ensure security of water supply as planned,” he said.

Ongkili said his ministry maintained that the parties involved should respect and adhere to the contents of the Master Agreement. “There are points in the agreement that require fine-tuning to the satisfaction of both parties,” he said, adding that the matters were pertaining to land and other water assets, which had already been agreed upon during discussions and negotiations in the crafting of the Master Agreement.

“We have not changed the goal posts nor added any new items in the agreement.All the Selangor Government needs to do is to comply to the terms,” he said.

Specifically, he said, they continued to claim that the land on which the Bukit Nenas and Semenyih plants sit belong to Selangor, which by law was a baseless claim.

Ongkili said the matters needed to be sorted out otherwise the Master Agreement would collapse and the Federal Government would have to revert to other options including legal recourse to exercise its right.

Discussions in the last two years have facilitated the signing of a memorandum of understanding (MoU) on the Selangor water restructuring on February 26 last year, a heads of agreement (HoA) on August 1 and finally the Master Agreement on September 2.

Although I regularly joke about WASIA but it is NOT so easy to be implemented. BN got to
change many rules and regulations in wasia before it is bullet Proof. Even so Pakatan, can
still challenge WASIA in commonwealth country courts ( England ) bcos WASIA is a LAW.
Law are meant to be broken!! The real problem it will be take 10--15 years of litigation, we will be
so burnt by then. I am so tired just thinking about it--need 2 cups of coffee now

Singor, wasia may not be so bad if fed takes over everything and paid agreed price to those willing sellers, leaving selangor state government and splash the only two dissatisfied entities

Kahhoeng. Wasia is Not part of the Master Agreement (signed). How sure Puncak is going
to get paid? From my understanding, wasia is only meant for Fed gov to implement Langat 2.
Once All Langat 2 projects are all implemented, politicans will wash their hands.

Singor, what I meant is to invoke WASIA to force through restructuring, offer prices and targeted companies remained the same. Its meant merely to take over the whole restructuring into fed's hand and to only release the management to state after the deal is completed. Thus, state won't have a say in the deal while Gamuda won't be able to sell SPLASH given mismatched price. Doubt this can happen myself, haha... just to release stress

“若雙方無法於5月11日在重組事宜上達成共識，那我就必須將此帶上董事會尋求展延；作為商峰控股及雪州水供公司的持有人，我們同意讓雪州政府接管水源資產，但我們現在需要有人在沒有條件及不再展延的情況下經營公司。”

羅查里也表示，展延已經限制商峰控股及雪州水供公司承接計劃，如更換水管等水務系統改善工作。

NHB: Resolve Selangor s Water Industry To Avoid Dry Taps
The issues related to restructuring of the water industry in Selangor needs to be resolved at the soonest to avoid taps running dry in the state with water reserves at below five per cent.
We need the Langat 2 now and additional water supply as reserves are very low, said Syabas and Puncak Niaga Holdings Bhd (PNHB) executive chairman, Tan Sri Rozali Ismail.
Langat 2 is a major water supply project for Selangor and Kuala Lumpur. It is expected to cater to the state s water supply needs up to 2025.
A further delay in resolving issues between Selangor and the federal government will put a strain on water reserves in the state as well as bring about serious economic implications, Rozali opined.
It will affect other developments as well, including the Langat 2, he told reporters after officiating the 9th Annual General Meeting of the Water Association of Selangor, Kuala Lumpur and Putrajaya (SWAN) here today.
He said the Hybrid Off River Augmentation System project by the Selangor government is only a short-term measure to ensure adequate water supply, while Langat 2 is needed to avoid a shortage over the longer term.
He added that Selangor and the federal government are still negotiating to fulfill certain terms and conditions under the sale and purchase agreement signed between both parties on Nov 11, 2014.
The date to finalise the proposed takeover of the water concession from Puncak Niaga (M) Sdn Bhd (PNSB)and Syabas by the state government has been delayed thrice.
It was initially set to be finalised on Feb 9, and later extended to March 9, and then to April 9. The latest date is May 11.
If both parties fail to resolve the water restructuring process by May 11, I have to bring the matter up with the board of directors for a further extension, said Rozali.
As the owner of Puncak Niaga and Syabas, we have agreed to the takeover of water assets by the Selangor government. We now need somebody to run the company without any conditions and further delay, he added.
PNHB had agreed to sell its unit, PNSB, and 70 per cent-owned Syabas to Pengurusan Air Selangor Sdn Bhd for RM1.55 billion on Nov 11, 2014.
Meanwhile, Rozali said the delay had restrained Puncak Niaga and Syabas from undertaking projects for the benefit of consumers and the water industry, such as an upgrade of the water system by replacing pipes.

Rozali seldom talk. When he talk people take note like in newspaper today. BN attack PR on water tariff hike in Penang recently so unlikely Puncak can get one. Best is to complete agreed water deal as soon as possible.
