Well... that's the point... they have to clear all these uncertainties before being able to be re-rated positively.... don't default on any payment... banks only care whether u have the means to repay them.

SD needs financing going forward....AR and SIR cannot drag on and on... otherwise, they better prepare a farewell banquet with red carpet to welcome the shareholders... please throw in limo service too....LOL

SD was given 14 market days to appoint another auditor with international affiliations to redo SIR..... and what about SC's own investigations? Still relevant? Or can proceed to prepare farewell dinner?

Since SIR is out, trading suspension should be lifted.... what is Bursa waiting for? SC should take action immediately... Now gotta see if the 2 high profile INEDs may resign cos their reputation are at stake if SD is guilty of wrongdoing....will Nexia resign too? A few possible reactions... wait and see.

There are a few articles about SC today... the timing of these articles are interesting.

Why are there articles about audit committee, INEDS etc suddenly?

Now can count the damages done by
1) Bursa's sudden suspension without warning... and
2) SD's nonchalant attitude towards datelines and regulations.
But most unbelievable of all, the local and foreign investors who confidently bought into a "shining star" of Malaysia may see every sen of their monies wiped out.... what a precedent should that happens.
The lawsuit between Bursa and SD is more about nitpicking words and phrases... "initial factual findings" or "independent special review findings".... definition of "material" and "immaterial" etc .
Holders just prepare for total losses... that way, the eventual outcome will not sting as much.

Bursa can always disclose what EY shared with them can't they? What about SC's investigations? They will announce "in a timely manner"... is Bursa's suit against SD necessary?

1) indeed. Karim had mentioned before that SD needs to develop more "cash" biz months back.. he already knew they will miss the coupon payment this month.
2) Karim is displaying a nonchalant attitude even though his billion ringgit empire is perilously near collapse.
That's why I said the timing of this pc of news is strange.
He has not mentioned a single word on how SD will navigate through the issues in hand that are threatening to get them delisted.

HAVING filed an unprecedented legal suit in Corporate Malaysia against market regulator Bursa Malaysia Securities Bhd on Monday (Nov 8), Serba Dinamik Holdings Bhd has filed an Originating Summons at the High Court against Ernst & Young Consulting Sdn Bhd (EY).

In its quest “to defend its rights, protect the company’s reputation as well as its shareholders’ interests”, the global integrated oil & gas (O&G) service provider is bringing EY to court on grounds that the latter is the purported “special auditor” chosen by Bursa Securities only to be appointed by the company.

In its legal action against Bursa Securities, Serba Dinamik has alleged that the market regulator has acted grossly in excess of authority and there is an underlying theme that it had interfered in the company’s audit process.

It further revealed that in the months of June and July, Bursa Securities had issued a directive to the company to appoint EY as the company’s special auditor to conduct a special independent review (SIR) with regard to auditing issues raised by the company’s previous external auditor KPMG PLT.

“Subsequently, in October 2021 Serba Dinamik was issued another directive by Bursa, demanding the company to announce a ‘Factual Findings Update’ which is understood as material that had been prepared by EY,” the company pointed out in statement.

“Both instructions were allegedly made on the justification that Bursa has the authority to do so under Main Market Listing Requirements (MMLR).”

Pursuant to the second directive dated Oct 22, the market regulator had suspended the trading of Serba Dinamik’s securities pending an announcement of the said “Factual Findings Update”.

Legal action against EY

Transpiring from the above events, Serba Dinamik is now calling into question the entire basis for the need of the SIR.
