the burden is to prove that the guy indeed knows his forecast is misleading. he is likely to say he does not know. on contrary, all forecasts are proven to be false anyway because nobody can predict the future. you want to prove in court all the big words above in paragraph 175, best of luck! you will be wasting time and money just on legal fee alone .. there is no merit or solid ground to charge the guy

Dont think SC can take any action at all. If the crime is very clear like robbing a bank, I am sure the polices are already all over this guy house by now. The best SC could do is to name and shame the guy so that public is aware. It is not like the guy is an expert, very professional, very ethical and very reputable and has a valid license, but in this particular case he has misused his position and reputation to mislead the public and create the 'pump and dump' to benefit from it. Then in this case he is guilty as charge but then again it is very difficult to prove all of the above because he is just none of the above ...

qqq3, then it should very clear that in this case he is not an expert just by your definition of an expert. so it only backfires. you cant go to court admitting our own fault.

but how do you prove it. it is a matter of opinion and perspective. and all transactions are independently done at their own will. everybody exercise their ridk and reward based on their judgement

and not to mention legally, this is not very straight forward case, can be complex and difficult to prove as it only backfires to Bursa how illiquid the Boatd is. nobody should be able to manipulate the price
2018-03-21 19:09 | Report Abuse
But realistically speaking is SC or Bursa empowered to catch and charge the culprit? BNM cant charge anybody other thsn rely on the authority to investigate and charge

Third, the impairment that they were talking about although it is massive, it is actually the antidote to its financial performance. Bet this company will bag more contracts after the impairment as their assets are very competitive in the market.

Second, this counter is not going kaput because it is still a strong company considering its asset, contracts in hand as well as experienced top executives

First, oil price will be very unlikely to go above 70 this year. There is oversupply at all storage point across the world and with US shale oil coming into the market

This counter going bankrupt? very unlikely. It will take time for the balance sheet to heal and this is just a corporate maneuver to stop the bleeding. If you are here for short term gain, you wont make any cents. But over long term period, this counter will rebound even if oil price stays at ~$45/bbl. 3 years from now, you will be asking yourself why you didnt buy when the price was at 40cents! kikiki

whats the target price of this Nestle. if it is sooo sooo good why cant any single trading house makes any fundamental report on Nestle? Does it have liquidity issue? Is Nestle going to issue more shares as the price is no longer representative of true value of the company? is Bursa monitoring this or just hide it under the carpet?

It is interesting that we are questioning EPF reaction. They should be given standing ovation on how fast their ‘muscle reflection’ is when the news came out from Affin Hwang. It is very rare to see large institution moved very swiftly over short period of time. What we should be questioning here is why would the BOD of two companies endorse the merger if they could see huge impairment issue. You dont join forces to push yourself further down the drain. You join forces to strategically position you better in the market and push share prices up.
2018-03-10 15:06 | Report Abuse
EPF modus operandi is very different than us retail investors. They cannot afford to have their money stuck in any company while waiting for the company to generate positive cash flow. They are not here to do betting that this company 'may be' going back to green or 'may be' oil will get to $100/bbl or 'may be' this and that. They need certainty to protect their own investors. It is clear the impairment is coming and they need to do what they do best. Pull out, minimise their losses and reinvest what they have left in other promising companies.

The 8bn impairment will get this company in the red territory in the next 18-24 months given low oil price and lack of offshore projects in the coming years. Suspect the current tenders they won would just offset or smoothen the impact of the impairment but will not be able to get them out to green. But they should be able to market their assets at lower breakeven after the impairment is paid up IF there are more offshore projects and oil continues to go up. EPF is doing it right.

Petrol price is the same at all these outlets. The best about Petron they dont spend too much on other associated extra spending to be no. 1 top spot which is costly. Their quarterly reports speaks for themselves. As long as they know where to land and how to run the business by not competing too much, they are on right track.
