KUALA LUMPUR: The 45-charges involving RM114 million against Datuk Seri Dr Ahmad Zahid Hamidi are not only related to funds belonging to Yayasan Akalbudi but also those of him getting kickbacks for awarding contracts while he was Home Minister.
The Umno president was accused of receiving gratification from contractors in return for projects awarded for the MyEG Services Berhad ("MYEG"), supply of passport chips and providing one stop centre (OSC) when he was Home Minister.
Zahid was accused of receiving RM13 million from a company called Mastoro Kenny IT Consultant & Services for the MyEG project under his former ministry.
He was accused of getting the kickbacks from July 15, 2016 and Feb last year.
The money was allegedly paid to him so that he would help Mastoro Kenny to obtain MyEG projects.
MyEG is an e-service provider that provides a wide range of government services including those related to the traffic police, the National Registration Department and the Immigration Department.
On charges related to the supply of passport chips, Zahid - who is also former deputy prime minister, was accused of getting RM5 million on April 26, 2017 from the director of Syarikat Data Sonic Group Berhad.
The contract reportedly worth RM318.75 million, was awarded to Datasonic Technologies Sdn Bhd in 2016.
The same company has also obtained a government contract to supply Malaysian passports until 2021.
According to the charges, Zahid received RM6 million from Datasonic director Chew Ben Ben on Apr 26 last year.
The money was said to have been transferred to an account belonging to law firm Lewis and Co.
Zahid is also facing two charges under Section 16(a)(B) of the Malaysian Anti-Corruption Commission (MACC) Act for receiving the RM6 million, in two transcations, as bribe to approve the project for Datasonic.
He faces a maximum 20 years’ jail sentence and a fine of up to RM30 million.
Late last year, Zahid had announced new Malaysian passports with enhanced features such as facial recognition and biometrics.
Zahid was also accused of receiving RM2 million last year from Azlan Shah Jaffril, a director of Profound Radiance Sdn Bhd, as inducement to appoint them to operate the One Stop Centre (OSC) to process work permits for Pakistani and Nepali workers.
He has claimed trial to all 45 charges of criminal breach of trust, money laundering and abuse of power involving over RM114 million.
The Bagan Datuk member of Parliament was hit with 10 counts of CBT, eight counts of receiving graft, and 27 for money laundering.

Stations and tunnels along the ECRL route
The East Coast Rail Link project will comprise a total of 20 stations, including 14 passenger stations, five combined passenger and freight stations, and one freight station.
“Freight transport along the East Coast rail link will account for 70% of the total revenue generated by the rail network.”
The route will have approximately 40 tunnels from Kota Bharu to Port Klang, including the 2.8km-long Kuantan Tunnel, the 1.1km-long Paka Tunnel, and the 871m-long Dungun Tunnel. The longest tunnel measuring 7km will be built in the Jelebu-Semenyih area.
The line will also feature multiple viaducts of approximately 100km in length.
Contractors involved
CCCC is the main contractor, while HSSI was appointed to provide supervising consultancy services, detail design, and shop drawing design consultancy services for the East Coast rail link.
Bursa Malaysia was selected as the engineering and project management consultant for the project, while logistics services are provided by FGV Holdings.
AECOM was contracted to supervise the stations, viaducts, tunnels, and depots of the project.
SANY supplied construction equipment such as cranes, rotary drilling rigs, concrete pump machinery and excavators.
ECRL project benefits
Cooperation between MRLSB and CCCC will increase the involvement of local contractors in ECRL’s civil works up to 40%. It will also improve bilateral relations between both countries.
The project is expected to generate jobs worth MYR17.6bn ($4.2bn) during the construction.
It will boost small and medium-sized businesses, as well as increase the demand for housing, supplies, and transport in the regions along the East Coast Rail Link.
The Kuantan Port-ECRL-Port Klang section will shorten the travel time between the two ports, thus benefiting trade in the region.
Freight transport along the East Coast rail link will account for 70% of the total revenue generated by the rail network, while the remaining 30% will be driven by passenger transport.

East Coast Rail Link (ECRL) project is a 640km railway link connecting different parts of the east coast region with the west coast region in Malaysia.
Malaysia Rail Link (MRLSB) is developing the project and will operate it in a 50:50 joint venture with China Communications Construction Company (CCCC). The Ministry of Transport, through Agensi Pengangkutan Awam Darat (APAD), will supervise and regulate the project.
Construction on the ECRL project began with the groundbreaking held in Kuantan, Malaysia, in August 2017, but the work was suspended in 2018 due to financial reasons. Construction resumed in July 2019, with the completion scheduled for December 2026.
ECRL is the biggest economic and trade project between China and Malaysia.
ECRL project background
The ECRL rail project was originally planned to be developed in two phases, with phase one covering 600km of track and phase two with an 88km stretch.
Some modifications have been made to the alignment due to cultural, heritage, and environmental concerns. The realigned stretch will run from Mentakab to Port Klang via Negeri Sembilan to avoid traverse through the Klang Gate Quartz Ridge.
The new alignment also resulted in a significant reduction in construction costs from MYR65.5bn ($15.8bn) to MYR44bn ($10bn), based on a comprehensive value engineering exercise.
ECRL route details
The new rail link will pass through the states of Kelantan, Terengganu, Pahang, Negeri Sembilan, WP Putrajaya, and Selangor. It will originate at Kota Bharu, the state capital of Kelantan, and terminate at Port Klang in Selangor. It will reduce the travel time from Kota Bharu to WP Putrajaya to approximately four hours.
The route will have three interchange stations along, namely Mentakab, Bangi/Kajang, and Putrajaya Sentral.
The Putrajaya Sentral station will be an interchange with Express Rail Link (ERL) for those travelling to Kuala Lumpur International Airport (KLIA) and KLIA2 and with Mass Rapid Transit 2 (MRT2) Sungai Buloh-Serdang-Putrajaya (SSP) line.
The line will interchange with KTM Electric Train Service (ETS) and KTM Komuter service at Bangi / Kajang, while the Mentakab station will allow the ECRL to interchange with KTM Intercity and KTM Kargo service.
The standard gauge double-track railway line will allow passenger trains to travel at speeds up to 160km/h and freight trains at 80km/h.

KUALA LUMPUR (Oct 19): Datasonic Group Bhd and My EG Services Bhd (MyEG) were both mentioned in the charges brought against former deputy prime minister Datuk Seri Ahmad Zahid Hamidi today.
The two stocks have been hammered following that. MyEG's share price tumbled 37 sen or 24.7% to RM1.13 in the morning seession, before it was suspended from trading. As at 3.45pm, Datasonic shed 19.5 sen or 29% to 50 sen, after rebounding from its intra-day low of 39.5 sen.
According to the charge sheet against Zahid, who is also the former Home Affairs Minister, he allegedly helped a company called Mastoro Kenny IT Consultant & Services to obtain projects from MyEG in return for payment.
He also allegedly received payment from Datasonic for the latter to secure a contract to supply IT chip for Malaysian passports.
On July 15, 2016, Zahid, through Lewis & Co, allegedly received a cheque worth RM250,000 from Jogabonito Jewellery & Diamonds to help Mastoro to obtain a contract from MyEG under the purview of the Ministry of Home Affairs under his capacity as the then minister, the charge sheet stated.
Between Dec 7, 2016 and Jan 5, 2017, Mastoro issued an additional 13 cheques worth RM8 million to Zahid for the same purpose.
The third charge, in which MyEG was also mentioned, involves 10 more cheques worth RM5 million issued by Berani & Jujur Trading on Feb 8, 2017, for Zahid to help Mastoro to obtain contracts from MyEG.
According to the charge sheet, on April 26, 2017, Zahid allegedly received a bribe from Chew Ben Ben, a director of Datasonic, in the form of two cheques worth RM5 million and RM1 million issued by Sarana Kencana Sdn Bhd to a Maybank account owned by Lewis & Co.
Zahid, under his capacity as the home affairs minister then, is said to have facilitated the appointment of Datasonic Technologies Sdn Bhd to undertake a five-year contract to provide 12.5 million chips for Malaysian passports to the Immigration Department under a direct negotiation process at the Ministry of Home Affairs.
However, Datasonic has clarified that neither the company nor any of its director made any payment to Zahid in relation to the supply of chips for passports.
In an announcement to Bursa Malaysia during market lunch break, Datasonic said its subsidiary Datasonic Technologies Sdn Bhd (DTSB) won a five-year contract to supply passport polycarbonate datapages and printing system based on per passport produce through an open tender in April 2012.
“DTSB was awarded for the supply of 12.5 million chips on Dec 15, 2015 based on value proposition of enhanced chips security (to put the chips bonded into the polycarbonate datapage instead of at the back of passport cover) and 15% lower pricing as compared to the previous vendor that provided a total saving of RM56.25 million to the government over a period of five years,” said Datasonic.

Construction sector prospects to remain muted in 2020
KUALA LUMPUR: Prospects for the construction sector are expected to be muted moving forward in 2020 as it continues to retreat from a supercycle fuelled by debt-funded public infrastructure projects, says AmInvestment Bank research.
The research house referred to the construction projects spanning over 10 years from 2008 to 2018 that have proved to be unsustainable.
"We believe valuations of construction stocks are lofty with a weighted average forward P/E of 18.9x on a weighted EPS growth rate of only 2.1% in FY20F," it said in a note.
AmInvestment currently has an underweight call on the sector, but may be upgrade it to neutral/overweight if the government decides to pump-prime the economy with public projects in the event of external shocks.
The research house's view on the sector was confirmed by the surprise 25bps overnight policy rate cut by Bank Neagara in January as the central bank looks towards monetary easing to sustain economic growth.
"While the government may introduce a stimulus package to counter the potential drag on the economy from the prolonged Wuhan coronavirus epidemic, we believe the focus will be on small-scale shovel-ready projects such as roads, pavements, bridges, schools and public amenities (that will benefit mainly the smallish and unlisted construction outfits)," said AmInvestment.
It added that public infrastructure spending in 2020 will be focused on completing ongoing projects at a reduced cost and/or over an extended construction period.
Such projects incude the East Coast Rail Link (ECRL) (RM44bil), MRT2 (RM30.5bil), LRT3 (RM16.6bil) and the Pan Borneo Highway, Sarawak (RM16.5bil).
AmInvestment believes the government will be reluctant to revive projects that are currently on hold. However, it added that there will be exceptions to this such as the Johor Bahru-Singapore Rapid Transit System (JB-Singapore RTS) (RM3.6bil) and Sarawak-Sabah Link Road (RM5.2bil).

ECRL: Negeri Sembilan's alignment to commence in 3rd quarter of 2020

China, Malaysia restart East Coast Rail Link project after year-long suspension
DUNGUN, Terengganu: China and Malaysia resumed construction of the East Coast Rail Link (ECRL) project in peninsula Malaysia on Thursday (Jul 25), after a year-long suspension and following a rare agreement to cut its cost by nearly a third to about US$11 billion.
The project was initially cancelled by Malaysian Prime Minister Mahathir Mohamad, who came to power after a shock election victory in May last year, as he followed through a pledge to renegotiate or cancel "unfair" Chinese mega-projects approved by his predecessor, Najib Razak.
But in April, the close trade partners agreed to proceed with the ECRL project at a cost of RM44 billion (US$10.7 billion), reducing it from RM65.5 billion.

ECRL Subcontract Works Of Up To RM11b Likely Only Source Of New Jobs In Budget 2020
The East Coast Rail Link (ECRL) — which is anticipated to have a civil works subcontract value of RM9 billion to RM11 billion — is likely to be the only source of immediate new order book for contractors in the upcoming Budget 2020 despite timing risks for new contract awards, says CGS-CIMB Research.
Its analyst Sharizan Rosely wrote in a note this morning that the research house is cautiously optimistic that new tender packages of the ECRL project can get off the ground in the fourth quarter of 2019 (4Q19).
“This is after considering the extended time needed to resolve and approve the new alignment and land acquisition, in addition to the structuring of the first few subcontract packages available to be tendered. In all likelihood, we expect the ECRL to be an immediate source of job awards for contractors in 2020.
“Our earlier estimate of the value of ECRL civil works remains intact at between RM22 billion and RM26 billion, being 50-60% of the total project cost of RM44 billion. Based on the 40% portion of civil works for local contractors and after including the 50km spur lines, we arrive at an estimated range of RM9 billion to RM11 billion,” he explained.
However, the research house does not rule out a possible delay in ECRL’s 4Q19 initial tenders, which could make a comeback with RM3 billion to RM5 billion worth of initial subcontract works in the first half of next year.
Meanwhile, Sharizan highlighted there could be wildcards for the construction sector from the upcoming Budget 2020, although priorities are likely limited to public transport projects already approved, such as the ECRL, Light Rail Transit 3, and Mass Rapid Transit 2 (MRT2).
This includes the potential relaunch of Mass Rapid Transit 3 (MRT3), and the possibility of Bayan Lepas LRT being included as a federal funded contract, which would then revive the overall Penang infrastructure angle under Penang Transport Master Plan (PTMP).
As for the Kuala Lumpur-Singapore High Speed Rail, Sharizan said it is still too soon for a revival theme.
“Post-Budget 2020, we generally expect sector job award growth to come off a low base, driven mainly by the ECRL.
“Contract award momentum has been subdued year to date, with upside risks in contract rollout coming from the JB-Singapore Rapid Transit System [Link], Bayan Lepas LRT and Pan Island Link 1 (PIL 1) in the second half of 2020 (2H20).

The US-based patient, a man in his 30s who is originally from Wuhan but who lives near Seattle, is resting comfortably at a medical centre and should return home in the “near future”, a medical officer said.

Chinese authorities on Thursday reported dozens of new infections, bringing the confirmed total to 571.
WHO chief Tedros said there was “stability” for the moment.
“We don’t see any significant variation but at the same time we also believe that we have to be cautious,” he said.

More than 570 people have been infected with the virus across China – with most cases found in Wuhan, where a seafood market that illegally sold wild animals has been identified as the epicentre of the outbreak.
The coronavirus has caused alarm because of its similarity to SARS (Severe Acute Respiratory Syndrome), which killed nearly 650 people across mainland China and Hong Kong in 2002-2003.
Like SARS, it can be passed among people through the respiratory tract.
The first case of the new virus was confirmed on Dec 31, and it has since been detected in Japan, Macau, South Korea, Taiwan, Thailand and the United States.
The World Health Organization on Wednesday delayed a decision on whether to declare a global health emergency – a rare instrument used only for the worst outbreaks.
After a meeting of an emergency committee in Geneva, WHO chief Tedros Adhanom Ghebreyesus said he needed “more information”.
The emergency committee will meet again from 1100 GMT on Thursday, after its chair, Didier Houssin, said the experts were split over declaring a public health emergency.
Though Tedros praised China’s “very, very strong measures” to contain the outbreak.
Asked about Wuhan’s transport shutdown, Tedros said: “By having a strong action not only will they control the outbreak in their country but they will also minimise the chances of this outbreak spreading internationally”.
‘Sealed off’
Wuhan’s special anti-virus command centre said the quarantine measures, which come into effect from 0200 GMT, are meant to “effectively cut off the virus spread, resolutely curb the outbreak and guarantee the people’s health and safety”, according to state media.
The city’s tourism and culture department cancelled all group tours until Feb 8, according to the official Xinhua news agency.
The city had already warned people to avoid entering or leaving Wuhan. Large public events for the Lunar New Year holiday, which starts Friday, were cancelled.
Authorities in Wuhan also made it mandatory to wear a mask in public places, according to state media.
The hashtag “Wuhan is sealed off” was trending on China’s Twitter-like Weibo, with more than 30 million views.
With hundreds of millions of people travelling across China this week for the Lunar New Year holiday, the National Health Commission announced on Wednesday measures to curb the disease – including sterilisation and ventilation at airports and bus stations, as well as inside planes and trains.

Public inspection on ECRL's Mentakab-Port Klang section starts on Jan 14
KUALA LUMPUR (Jan 11): The East Coast Rail Link's proposed Mentakab-Port Klang alignment, which will go through Negeri Sembilan and Putrajaya, will be on display for public inspection starting Tuesday (Jan 14).
The three-month inspection is for the public to provide feedback and suggestions on the new alignment that spans from Pahang to Selangor, said Malaysia Rail Link Sdn Bhd — a wholly-owned unit of the Minister of Finance Inc and the ECRL project and asset owner — in a statement yesterday.
The alignment, also known as Section C, comprises a mainline measuring 143.1km in length, a spurline of 41.5km, five passenger/freight stations, and a future station.
The new alignment was conceived to avoid the costly construction of the 17.8km long Genting Tunnel under the initial ECRL route, as well as to stay clear of the Klang Gates Quartz Ridge in Selangor, which is being established as a UNESCO World Heritage site, said MRL chief executive officer Datuk Seri Darwis Abdul Razak.
“The Section C alignment is crucial in the formation of a land bridge between Kuantan Port and Port Klang, where the 640-km ECRL network will end. This will pave the way for increase [in] freight transactions due to shorter travel time between the two ports,” he said, adding the Mentakab-Port Klang stretch via a more southerly route, took into greater consideration of rail connectivity, environmental safeguards, and social-economic impact.
“In line with the Public Inspection for Section C, MRL has initiated the Environmental Impact Assessment, Social Impact Assessment, and Heritage Impact Assessment reports for consideration by relevant authorities, in a bid to obtain the final approval of the Mentakab-Port Klang Railway Scheme from APAD,” he said.
In particular, the route will have designated passenger and freight stations at Temerloh in Pahang and Jenjarom in Selangor, with passenger-only stations at Klawang and Nilai in Negeri Sembilan, as well as Putrajaya Sentral in Putrajaya.
MRL said it recently received conditional approval for the ECRL Railway Scheme for Section C from Agensi Pengangkutan Awam Darat (APAD). Barring the final approval of the Railway Scheme for Section C, civil works for the Mentakab-Port Klang stretch including earthworks and foundation works, is targeted to commence from July 2020 onwards.
Preliminary works, such as topography survey, are now ongoing at multiple spots along the Section C alignment, while soil investigation works are expected to commence soon, Darwis said.
“MRL is pleased that the overall progress of the ECRL project has increased to 14.49% currently, boosted primarily by ongoing construction works at 27 priority locations within its Dungun to Mentakab alignment (also known as Section B),” he added.
Meanwhile, MRL said the public information booths for Section C will operate on work days at APAD headquarters in Kuala Lumpur, and at the Ministry of Transport in Putrajaya during the three-month public inspection period that will end on April 14, 2020.
Five more public inspection booths will be operating at the respective Pejabat Daerah dan Tanah at Temerloh (Pahang), Jelebu and Seremban (Negeri Sembilan), Sepang and Kuala Langat (Selangor) from Jan 20 onwards, MRL added.

With China Communications Construction Company Ltd (CCCC) as the main contractor, the 640-km ECRL that is scheduled for completion by December 2026, will traverse the East Coast states of Kelantan, Terengganu and Pahang, as well as Negeri Sembilan, Putrajaya and Selangor on the West Coast.
