Power plant investors are fully aware of the impact of environment issues. Hence, the level of permitted pollutions are specified in the BOT contracts. As long as the power plant meets the agreed pollution limits, operations will be approved.

For a power plant to achieve COD, it must meet the agreed pollution targets set by the Vietnam government. So long as the power plant operates within the limits, it is not responsible for environmental issues, if any.

one of the unit already started commercial operation on 24/11/2020. Tariff payments are received by JHDP on monthly basis from EVN. Dividend to shareholders will only be possible after all cash reserve requirements are met which will take up to 15 months.

Those who have followed my advice and bought 1,000 shares of Jaks in Oct 2018 at RM0.50 and subscribed for the warrant rights, their investment return will be;
1,000 Jaks (cost 0.50) = RM500
500 Jaks-WB (cost 0.25) = RM125
Total costs = RM625
At current prices, they are worth
1,000 Jaks (0.66) = RM660
500 Jaks-WB (0.415) = RM125
448 Jaks-WB (0.415) = RM186
1,600 Jaks (0.66) = RM1,056
800 Jaks-WC (0.395) = RM316
Total worth = RM2,343
After deducting for the cost of latest right issue of RM352, this is a total investment return of 218% in 2 years !

In order to take up the right issue, you need to have excess fund. Otherwise, you are severely disadvantaged especially by large right issues. Is one allowed to sell part of the right entitlement in order to take up the rests of the entitlements ? I m referring to the recently right issue by Jaks resources. Instead of make big gains post right issue, portfolio with Jaks counter showed big losses.

You should not waste your time trying to second guess my motive. You should spend more time to think over what I have put forward. I m not here trying to convince disbelievers. I have written enough articles to lay out my rationale for buying Jaks. If anyone still in doubt, you need to find your own ways or perhaps you just have to let Jaks pass.

In Mong Duong II case, AES owns a 51% stake while POSCO Power subsidiary PSC Energy Global and Stable Investment have a respective stake 30% and 19% in the project.
There is shareholder agreement governing numerous reserve matters which require unanimous board decision to overturn. Full distribution of idle cash is one of the reserve matter, changing of board composition is also a reserve matter among many others. The biggest shareholder will take the CEO position while the next biggest will have the CFO post.
Mong Duong II has been paying dividend every year since commercial operation.
Jaks will eventually have 2 out of 5 board seats in both JHDP and JPP.
Therefore, there is no risk of CPECC refusing to pay dividend.

hobobem DK, if jaks is the minority shareholder, then they are dependent on the major shareholder for the cash dividend from profit share. What if the major shareholder play dirty and don't declare dividend, then jaks is at their mercy. do you think this is a risk factor?

sosfinance, JHDP's distribution policy is likely to follow Mong Duong II which is to distribute all idle cash to its shareholders as per its shareholder agreement. 100% USD foreign exchange and repatriation is guaranteed by the Vietnam Government. However, Jaks has no formal dividend policy yet.

sosfinance DK, it's important to know what is the JHDP's dividend (and repatriation policy) and JAKS's dividend policy. If unable to know both, depends how good is your guessing game.

Blee, Jaks secured the power plant from the vietnam government. It has an upper hand in bargaining for share of construction profit when CPECC was selected by Jaks as his partner.

Jaks will report the profit as "share of profit of associated company" in the P&L statement. Dividend will be reflected in the cash flow statement.

As far as construction profit is concerned, we know that Jaks is likely to gain around RM440m from the USD454m EPC contract works which were fully subcontracted to a subsidiary of CEEC.
As for operation profit, it will be shared base on ownership.

Under the BOT contract, JHDP is exempted from taxation for the first 4 years, 5% tax for the next 9 years, and 10% for the remaining years.

this will translate to 33 cents eps per year..After deduct tax, shd be around 20 cents, as vietnam company tax is 35%...

Sources of energy supply is always in hot debate and subject to environment scrutiny especially coal power plant. That is why operators of coal power plant in Vietnam demand security measures to be built into the BOT contracts to safeguard the foreign investment capital. Hence, the capacity payment within the power purchase agreement must be paid by Vietnam regardless of the state of operation of the power plant as long as the power plant is made available for power generation. The BOT contracts protect the operators from any change in laws or regulations. Therefore, while the Vietnam may have different policies on power generation in the future, it will not affect the BOT contract given to JHDP.
