@sop, granted, there are opportunity and trap in the stock market. But what cannot be trusted is that Tony Tan even walloped the staff EPF and did not remit to EPF, together with Tanco's employer's contributions. This is very unfair, cruel and unethical to the staff. How can I even pay $ 0.17 per share for Tanco that is still under his and his family (Dato Lynne Tan and Andrew Tan) stewardship?

The AG , must be free to go to London to get advise. I think we are in primitive age . No telephone , internet , or management delegation. The director general of tourism was so free to go to SWEDEN to watch the trial of his staff. We watched the great performance of KETUANAN MELAYU 's government, IGP , DCA, AIR FORCE GENERAL, MAS CEO, IMMIGRATION of course the acting minister transport. Semua MELAYU , no East Malaysia BUMIPUTERA or chinese & Indian. We have to put up with the racist government drama.

Minnpost said a CNN estimate that suits litigated in Malaysia or China could only fetch compensations of US$1 million per passenger.

That is not to say that lucrative compensation is assured in US courts.

The daily noted that in the Air France flight 447 crash of 2009, families involved had little success filing their suits in American courts, as judges dismissed them for not fulfilling one of the requirements for a suit to be filed there, as spelled out by the Montreal convention.

The settlements in the suits involving the Northwest crash, one of the deadliest in US history, ranged from US$1 million to US$2 million per passenger, with attorneys earning an estimated 25% to 33% share, Minnpost reported.

In the case of MH370, "Industry analysts estimate that a US-based suit can garner a US$8 million to US$10 million settlement. At the same time, the standard for negligence and liability is particularly narrow in most foreign countries."

The huge settlement awarded by American courts – with each suit likely fetching between US$8 (RM26.5 million) and US$10 million in settlement – makes American law firms the choice, and this explains the current "gold rush."

To illustrate how aggressive American law firms are when it comes to filing compensation claims on behalf of family of passengers, Minnpost recalled how in the aftermath of the Northwest Airlines crash of 1987, one law firm sent its agent disguised as a priest to mingle with distraught relatives of passengers, before finally getting a copy of the flight manifest containing contact names of family members of passengers.

In the case of MH370, which went missing en route from Kuala Lumpur to Beijing on March 8, the affected family members have the choice of filing a suit not only in the two cities involved, but also in the country where the ticket was purchased, the home base of the airline (Malaysia, in this case) or the principal place of residence of the passenger.

A provision in the Montreal Convention, an international agreement signed by all countries to provide uniformity of rules for international carriage, including matters related to air crash compensation, gives families of victims several options to file their suits against an airline.

Despite having only three American passengers on board the missing Malaysia Airlines flight MH370, there is intense activity in the courts in the United States – with American law firms taking part in a "gold rush" to grab a share of the lucrative airline accident compensation for which their courts are known.

"Because US courts are the only venue where the settlement damages recognise the value of the passengers’ enduring companionship and lost income, it is always the preferred location to file a suit," reported a Minnesota-based local daily, Minnpost.

MAS Flight 370 went missing on March 8 when it was mysteriously diverted from its original flight path to Beijing and is presumed to have crashed in the southern Indian Ocean.

Despite what has been considered as the largest search operation in aviation history, no wreckage or debris has been found since it vanished almost a month ago. It was carrying 12 crew members and 227 passengers.

Nunan (right) added that once a piece of wreckage is found, crash investigators typically go to the extent of drawing out an outline of the aircraft in an hangar, and try to piece it together like a jigsaw puzzle and figure out what had happened.

Although it took two years to recover that aircraft's black box, pieces of it had been found much earlier and there were other indications of problems.

"They were able to find debris in a couple of weeks. They knew the location within a couple of days. So even though it took two years to pull the aircraft out, a lot could be done and pieced together, based on the location where the pieces were found," Wheeler said.

Despite arguing that MAS is an easy target, Nunan nevertheless said the MH370 case was extremely complex.

"This is probably the most complex case that I know of in the last 30 to 40 years," he said.

"In that period of time, you have probably the greatest number of serious aircraft crashes. This (MH370) outshines Air France significantly,” he said, referring to Flight 447 that crashed into the Atlantic Ocean in 2009.

Asked about a potential act of terrorism, Wheeler said it could still be argued that MAS and the KL International Airport security should have taken certain steps to prevent this.

Shine Lawyers manager, Patrick Nunan said this approach has been used in suits before, such as those following the Sept 11, 2001, terrorist attacks on the World Trade Centre in New Yorik and the Pentagon in Washington in the United States.

"It is to the extent of what you can prove that you have lost, so one family may be able to prove a million dollars, another family may be able prove five," said the lawyer from the Australian firm Shine Lawyers.

Wheeler said he is representing the relatives of some of those on board the aircraft, but declined to disclose who or how many, citing client-counsel confidentiality.

Without the means to defend themselves, Wheeler said, the next-of-kin of the passengers aboard MH370 could be awarded the full amount of whatever sum they can prove as their losses.

The court will consider factors such as loss of income, the deceased's likely future income, loss of support, and how much the next-of-kin are dependent on the deceased.

Malaysia is one of the signatories to the Montreal Convention, which spells out liabilities in event of damage or loss of air cargo, baggage, or passengers. On the other hand, crew members are covered by workers' compensation schemes.

"The evidence isn’t there for them to argue that they weren’t at fault. They can’t argue that something else was at fault, like an aircraft component or a terrorist bombing - something that is potentially not in their control.

"We are thinking that families will have that high level of proven loss damage available to them if there is no debris, because MAS hasn't got a chance to prove itself," Wheeler told Malaysiakini in an interview yesterday.

To fend off suits claiming damages higher than XDR113,100, according to the convention, MAS will have need to prove in court that the loss of the aircraft was not due to its own negligence, or that a third party was solely responsible for it.

This is where MAS may hit a stumbling block.

With no trace of Malaysia Airlines (MAS) Flight MH370 found thus far, aviation lawyers warn that the national carrier is wide open to lawsuits from the relatives of those on board.

Brisbane-based lawyer Joseph Wheeler (left) explained that under the Montreal Convention of 1999 (updated in 2009), airlines were strictly liable to damages of up to XDR113,100 (approximately RM575,000).

XDR is a monetary unit commonly used by international organisations and treaties, including the Montreal Convention.

Malaysia Airlines has cancelled one out of two daily flights on the Kuala Lumpur-Beijing route effective May 1, presumably due to a drop in demand for flights between China and Malaysia in the wake of the MH370 tragedy.

The daily redeye flight with the flight number MH318 departing Kuala Lumpur for Beijing at 12:25am has been removed from Malaysia Airlines’ online booking engine for departures from May 1 onwards.

Malaysia Airports Holdings Bhd (MAHB) managing director Tan Sri Bashir Ahmad Abdul Majid should be sacked for incompetence and gross mismanagement over the construction of klia2, a DAP lawmaker said today.

Party national publicity chief Tony Pua said Prime Minister Datuk Seri Najib Razak should send a clear message to all government-linked companies (GLCs) that he would not tolerate incompetence and gross mismanagement.

Najib no longer had any excuse not to act against the top management of MAHB, Pua said in a statement.

A commercial aircraft (assuming that you somehow knew what it was) making an U-turn with its transponder off has either to be hostile or is in distress.

Letting it out of your sight is a mortal sin. The least you could have done was scrambling your jets to identify it and have visual contact to determine its location in the event that it was hijacked or crashed.
