They cannot, as Sivarasa said, report to the party instead of to the boss when the Sultan appointed them on the advise of this boss.

Technically, since yesterday, when PKR sacked Khalid Ibrahim from the party, Selangor no longer has a Pakatan Rakyat government. It has a Khalid Ibrahim government. That is the implication of the present situation in Selangor.

Law expert Dr Abdul Aziz Bari is of the opinion that the sacking of Khalid spells the end to the Pakatan Rakyat government until a new Pakatan Rakyat Menteri Besar is appointed with the consent of HRH the Sultan of Selangor.

Dr Aziz is also of the opinion that Khalid no longer has any power to continue running Selangor because once he is sacked then the ten-member EXCO that he appointed is also considered automatically sacked since the EXCO is the Menteri Besar’s EXCO.

PKR Supreme Council member R. Sivarasa more or less confirmed this when he said that the EXCO would no longer report to or take instructions from the Menteri Besar but would now come under Pakatan Rakyat.

According to the Constitution, however, the EXCO is appointed by the Ruler on the advise of the Menteri Besar. Hence whether what Sivarasa said is legal or not is certainly questionable. If the EXCO does not report to him or refuses to follow his instructions, Khalid can actually have them removed and a new EXCO is appointed (by the Sultan).

When Khalid became the Menteri Besar as a Pakatan Rakyat representative, understandably, he would appoint his EXCO based on the wishes of his party. This means Pakatan Rakyat would submit the names of the ten to be appointed to the EXCO.

Now, however, since he is an independent and no longer belongs to any party, he need not listen to the party and can actually appoint a new EXCO of his own choosing.

The moral thing for Pakatan Rakyat to now do is to ask the ten EXCO members to resign. Would any Pakatan Rakyat representative want to serve as an EXCO member in, say, Kedah, which has a Barisan Nasional Menteri Besar? If the Pakatan Rakyat representative in Kedah is offered an EXCO post in Kedah and if he or she accepts that would be seen as a sell-out or betrayal and he or she would definitely face a sacking from the party.

The question of whether Khalid stays on as the Selangor Menteri Besar depends on whether he still has the support of the majority of the House, in this case the 56 State Assemblypersons. And to determine this can be done in two ways.

One would be a vote of no confidence is tabled in November during the next sitting of the House and if at least 29 of the 56 representatives vote against Khalid then it would be considered as he has lost the majority support.

The next method could be for HRH the Sultan to summon the representatives one-by-one to ask them their stand regarding Khalid and if at least 29 indicate they have lost confidence in Khalid then this, too, can be considered as he has lost the support of the majority.

In the meantime, until it has been determined whether he has lost the support of the majority or not, Khalid can continue serving as the Menteri Besar.

Prime Minister Tun Dr Mahathir Mohamad once faced the same issue in 1988 when Umno was deregistered. He continued serving as Prime Minister although he no longer belonged to any party and was an independent Prime Minister.

No doubt they could have ousted him with a no confidence vote in Parliament but they did not. Hence Dr Mahathir continued as Prime Minister until Umno Baru was formed and the new party was admitted into Barisan Nasional as a coalition partner.

The circumstances in 1988 may have been different from what happened yesterday. Nevertheless, the issue here is whether a Prime Minister or Menteri Besar can become an independent or party-less and continue to legally stay on as the CEO.

He can.

The moral thing for them to do, though, would be to resign to show that they no longer support or have confidence in Khalid because if they remain as EXCO members then this would be seen as they are endorsing Khalid’s leadership.

damn you finish, no damn you finish. what a great moves. It is better that all PR reps resigned and fresh election is call. Sometimes, you cannot expect the authoritarian to follows rules.

When d party gives more say and freedom to d members, some, espcially d privilage one, abused them for their own selfish motives as that they r indepensable and party's rules r not applied to them and put themselves at d same level as d party's elected top leaders. If d party b like d dictator as d previous regime that ruled for more than two decades, d members revolted for more say and freedom that gave birth to d present party and many including d prima donna rushed in to take advantage of d vast opportunities in d new party where ppls have high hope for d long awaited change... but d prima donna spoilt it.. using d notion of 'for d good of d ppls'...

IN LIFE ONE MUST GO BACK TO BASIC FIRST PRINCIPLES AND RELY ON BASIC FIRST PRINCIPLES FOR DECISION MAKING.

Tan Sri Khalid was the CHOSEN candidate by Pakatan to be the Mentri Besar. Pakatan has the right to decide who is Mentri Besar as Pakatan had won the majority of ADUN seats. The State constitution is very clear on this matter. The majority party , PAKATAN RAKYAT parties, form the state government. THE MAJORITY PARTY DECIDES ON WHO SHALL BE THE MENTRI BESAR.

Based on first principle, Khalid became Mentri Besar because Pakatan decided to nominate him for the second term. The SULTAN approved PAKATAN choice of Khalid as Mentri Besar.

Now after he had been sacked and is PARTYLESS, he turned around and says that
-NOW SELANGOR STATE GOVT IS TAN SRI KHALID GOVERNMENT AS HE ADVISED THE SULTAN THAT HE HAD MAJORITY SUPPORT
- NOW MAJORITY OF 32 ADUNS HAD SIGNED SD STATING THAT THEY SUPPORT AZIZAH BEING THE NEXT MENTRI BESAR.
- KHALID EVEN HAD THE AUDACITY TO SAY HE ONLY NEED 4 EXCO MEMBERS TO RUN THE STATE GOVT. THIS SAYS ALOT OF HIS MANAGEMENT STYLE!!
- IS HE A DICTATOR OR AN INCLUSIVE MENTRI BESAR? HIS PAST ACTIONS AND HIS RECENT STATEMENT OF LATE SHOWED THAT HE DID NOT PRACTISE INCLUSIVE GOVERNMENT.
- WHY HAD KHALID PRACTICED A DICTATORIAL STYLE OF GOVERNING? WHAT IS HIS REAL MOTIVE IN DOING SO?
- HAS ANYONE SEEN HIM CAMPAIGNING NATIONWIDE FOR PAKATAN RAKYAT DURING THE LAST GENERAL ELECTION?
-HOW MUCH VALUE HAD KHALID ADDED TO PAKATAN ALL THESE YEARS? WHY DID HE RUN AWAY FROM IJOK? WHAT HAS HE GOT TO HIDE?
- DID KHALID BACK UP HIS INFO WITH REAL FACTS ON MAJORITY SUPPORT BY ADVISING THE SULTAN THAT HE HAD MAJORITY SUPPORT? WHAT IS THE BASIS OF HIS ADVISE TO THE SULTAN THAT HE HAD MAJORITY SUPPORT? WHERE IS THE WRITTEN DOCUMENTS BY THE MAJORITY OF ADUNS WHO SUPPORTED KHALID?
-HAS KHALID DELIBERATELY MISLED THE SULTAN?
-HAS HE USURPED THE RAKYATS DECISION POWER BY DECLARING THAT SEALANGOR GOVT NOW IS KHALID GOVT?
- WHAT IS THE BASIS OF KHALIDS CLAIM THAT THE SELANGOR STATE GOVERNMENT IS NOW KHALIDS GOVERNMENT?
-IF PAKATAN HAD NOT CHOSEN HIM TO BE MENTRI BESAR, CAN KHALID BE MENTRI BESAR FOR SECOND TERM?
-WHO IS HE TRYING TO CON?
-DOES'NT KHALID HAD AN IOTA OF MARUAH or SELF RESPECT.
-KHALID STILL HAS TIME TO REDEEM HIMSELF AND TO REDEEM HIS MARUAH AND IT IS BEST ADVISED THAT KHALID APOLGIZE TO THE RAKYAT, ACCEPT THE NEXT CHOSEN MENTRI BESAR AND THEREAFTER GRACEFULLY STEP DOWN AND EXIT THE POLITICAL SCENE AS HE HAD THOROUGHLY DISGRACED HIMSELF.

UNDENIABLE FACT IS KHALID IS NOW ONE INDEPENDENT ADUN WHO OBTAINED HIS MENTRI BESAR POSITION BECAUSE PAKATAN HAD CHOSEN HIM AFTER THE SELANGOR STATE GENERAL ELECTIONS WHEN HE WAS A PKR PARTY MEMBER.

Khalid now has NO PARTY. HE IS JUST ONE INDEPENDENT ADUN WHO HAD BEEN SACKED FROM PKR. IF HE HAS ANY MARUAH LEFT ,HE SHOULD JUST RESIGN AND WELCOME IN AZIZAH AS THE NEXT MENTRI BESAR.

SO IT IS UP TO THE PAKATAN RAKYAT TO DECIDE ON WHO SHALL BE THE NEXT MENTRI BESAR OF SELANGOR. There is no necessity for a fresh state election as it a pure waste of public funds and it is better to employ the funds for state projects that yield benefit for the rakyat in Selangor.

It now all boils down to PAS. Support PR and back to status quo minus the dictator. Decide otherwise, DAP and PKR will have to move on.Many who have voted for PAS will never never vote them again for a long long time to come. You cannot deal with unprincipled persons. The good thing in PAS is that many of the younger generation go for inclusiveness and this is a good sign BUT it will take at least another generation to weed off the ulamas faction, if ever such things take place.
