Datuk Mat Zain Ibrahim has lodged a police report against Tan Sri Muhammad Shafee Abdullah (pic), saying the Umno lawyer’s affidavit to the Court of Appeal contained inaccuracies, an offence under the law.
The former Kuala Lumpur Criminal Investigation Department director lodged the report at the Setapak police station this afternoon.
Shafee had filed the affidavit at the Court of Appeal last week in response to Datuk Seri Anwar Ibrahim's second application to disqualify the lawyer from representing Putrajaya as deputy public prosecutor in the government’s appeal against Anwar’s acquittal on the second sodomy charge.
Anwar's application will be heard in the Court of Appeal on December 19, Thursday.
In his police report, Mat Zain claimed Shafee had committed at least two offences under the Penal Code, the first for making false statements in the affidavit.
He alleged that Shafee had also suppressed material evidence with the intention of deceiving the court.
He said that Shafee had received from him a set of documents on September 24, 2013.
"These were documents Shafee had asked from me after meeting Tun Dr Mahathir Muhamad at his residence last August 10, the third day of Hari Raya," he said.
Shafee told reporters on Wednesday that he had filed an affidavit on what transpired in his legal firm and at the residence of Tun Dr Mahathir Mohamad.
Shafee went on to say that Mat Zain had "slanted" what he had said in his October 7 statutory declaration (SD).
"My affidavit is supported by former (Commercial Crime Investigations Department director) Datuk Ramli Yusuff. I do not need to ask Matthias Chang to affirm it, and there is no need to trouble Tun (Dr Mahathir Mohamad)," Shafee said when asked to respond to the contents of the SD.
The SD by Mat Zain was prepared following a meeting in Dr Mahathir's house, attended by, among others, Dr Mahathir's former political secretary Matthias Chang, and Ramli, who had briefed the former premier over his run-ins with Attorney General Tan Sri Abdul Gani Patail.
Shafee had vowed to expose in court a link between Mat Zain and Anwar as the former had filed a defamation suit against the former prime minister, but was not serious about the case, resulting in the court striking out the matter.
Mat Zain had then shot back at Shafee, claiming the contents in the affidavit was "a load of rubbish".
Anwar filed the application on December 6 using Mat Zain's SD as grounds to disqualify Shafee, saying Shafee's appointment to lead the prosecution team would deny him a fair trial.
The PKR de-facto leader said that Shafee knew of Gani's illegal actions in the Pulau Batu Puteh territorial dispute between Malaysia and Singapore.
Anwar said the SD also pointed to Gani and former inspector-general of police Tan Sri Musa Hassan's involvement in fabricating evidence in the "black eye" incident of 1998.
The alleged fabrication took place when Gani was said to have brought in pathologist Dr Abdul Rahman Yusoff to accuse Anwar in court of self-inflicted injuries, contradicting medical reports.
A Royal Commission of Inquiry ended with an admission by former police chief Tan Sri Abdul Rahim Noor that he had beaten Anwar hours after his arrest on September 20, 1998.
Anwar had in 2008 filed a police report against Gani and Musa, who was involved in the first sodomy case brought against Anwar.
A three-member committee, comprising retired judges, formed by the Malaysian Anti-Corruption Commission (MACC), cleared the duo.
Shafee reportedly agreed during the meeting in Dr Mahathir's house that the MACC committee was illegal.
On November 21, the Federal Court dismissed Anwar's appeal, declaring that Gani could give a temporary licence to Shafee to lead the prosecution. Anwar then filed an application to dismiss Shafee on the grounds that the appointment was illegal.
Anwar, 66, was acquitted by the High Court on January 9 last year on a charge of sodomising his former aide Mohd Saiful Bukhari Azlan at a Desa Damansara condominium unit in Bukit Damansara in 2008. - December 15, 2013.

PKR’s Rafizi Ramli will seek help from Hong Kong’s graftbusters once again, this time over bribery allegations against Attorney-General (AG) Tan Sri Abdul Gani Patail which purportedly led to Malaysia losing its claim on Pulau Batu Puteh to Singapore in 2007.
Despite admitting that it would not be easy to implicate Gani, Rafizi hoped that the action will garner a response from Putrajaya, including suspending the AG pending the investigation.
“They have the authority and power to investigate any financial transactions into Hong Kong if there is reasonable ground to believe that the money was a part of corruption,
“We need to compile to provide some information to Hong Kong authority which we will do within the next few days. (Then), I will wait for their response.”
Rafizi, known as PKR’s “expose man” and the executive director for National Oversight and Whistleblowers Centre, has also set this Wednesday as the deadline to gather the information on Gani.
This will be Rafizi’s second report to the island’s Independent Commission Against Corruption, after the murky RM40 million “political donation” to Sabah Umno scandal back in November last year.
The move follows a revelation by former Kuala Lumpur Crime Investigation Department chief Datuk Mat Zain Ibrahim in his 31-page statutory declaration sent to the Prime Minister’s Office on October 9.

PETALING JAYA: Rafizi Ramli will seek help from the Hong Kong government over former Kuala Lumpur CID chief Mat Zain’s allegations that money changed hands, which led to Malaysia losing its claim on Pulau Batu Puteh to Singapore in 2007.
The revelation was made in Mat Zain’s 31-page statutory declaration (SD) sent to the Prime Minister’s Office on Oct 9 which revealed the wrongdoings of Attorney-General Abdul Gani Patail, who handled the Pulau Batu Puteh case.
“Also included was information that a large amount of money changed hands and was credited into (Gani’s) bank account in Hong Kong,”
the SD said.
Speaking to reporters today, Rafizi, who is PKR strategic director, announced that he will approach the Hong Kong government in hopes they will commence investigations into Mat Zain’s allegations.
“What is more pertinent about this SD is that for the first time, there is a serious allegation made involving the territorial integrity of the country. This is bringing corruption to a new level altogether.
“The police say they won’t take any action against him (Gani), and there is no news from SPRM (Malaysian Anti-Corruption Commission),” he said.
“Therefore, we have no choice but to bring this issue to Hong Kong, as the reputation of their financial institution is of utmost importance to them,” added Rafizi.

PETALING JAYA: Transparency International (TI) Malaysia has lauded the pay hike for Selangor elected representatives, saying it will deter corruption among the leaders and put pressure on them to be more productive.
Its secretary-general Dr Loi Kheng Min said while being well-paid did not equate zero corruption, it helped to discourage leaders from taking bribes.
“However, more importantly, there should be an open government policy which includes asset declaration.
“If you are so highly-paid, then you must show that you are deserving of the salary and do a good job,” he said when contacted yesterday.
Dr Loi suggested that local councillors be given a pay hike too as they dealt directly with the people.
It was reported that the state assembly had on Wednesday approved the salary increases, which will among others, see the Selangor Mentri Besar earning RM29,250 a month from RM14,175 while an assemblyman’s pay will be raised from RM6,000 to RM11,250 a month.
Council of Former Parliamentarians Malaysia president Tan Sri Abdul Aziz Abdul Rahman proposed that all states implement uniform salaries for elected representatives so that there would not be any discrepancies.
“There should not be any arbitrary increases. Now it seems like each state is trying to outdo each other.
“Salaries of all state leaders should be the same to avoid dissatisfaction among those who earn less,” he said, adding that assemblymen in each state had similar duties.
Asli Centre of Public Policy Studies chairman Tan Sri Ramon Navaratnam said the pay hike in Selangor was acceptable seeing that wages had not been adjusted for a long time, but the quantum was too high.
“The state government should have consulted the people on this as the move seems to be arbitrary. They are making the same mistake as the Kuala Lumpur City Hall which had not consulted the people before increasing assessment rates,” he said.

Parties from both sides of the political divide are united in their opposition to any move that will allow Perkasa to establish a foothold in the state.
Most have cited the risk of Perkasa causing racial disorder with its extreme and disruptive statements as a reason to keep the group out of Sarawak.
The reaction has caught Perkasa leaders by surprise. Some have admitted to being “dumbfounded” by the amount of venom directed at them.
Perhaps the fears felt by the people of Sarawak are not unwarranted. Perkasa has been labelled as extremist and racist. It has unashamedly stated that the defence of Malay rights is its primary objective, and even wants the government to stop offering any more concessions to the Chinese – ignoring the fact that the Chinese have never received any such offer of value.

Youth being sold lies, says ex-Election Commission official
The youth in the country depend on online news sources which do not provide “accurate” information unlike the mainstream media, says former Election Commission vice-chairman Datuk Wan Ahmad Wan Omar (pic).
The recently retired civil servant said young Malaysians were among the most critical of the commission’s work and they “are the most effective at spreading information”.
“But they do not have time to watch television and view the prime channels which carry accurate information, based on ethical journalism or newspapers that print actual facts,” he told Umno-backed daily Utusan Malaysia’s weekend edition “Mingguan Malaysia” today.
“They shut their eyes and ears from explanations,” he added.
Wan Ahmad told the paper that the EC had often been misunderstood and he insisted that the body under the auspices of the Yang di-Pertuan Agong had been fair and just to all.
He also declared innocence over claims that he was impartial in his job.
“Even though people accuse me of being unfair, playing politics and being impartial, all of those assumptions are not true.”
For years, the EC came under fire for not acting as an independent or non-partisan body, an accusation that the body has repeatedly refuted.
Former EC chairman Tan Sri Abdul Rashid Abdul Rahman recently admitted that the EC was only an appendage of Umno and Barisan Nasional to ensure their perpetual stranglehold on Putrajaya.
Opposition coalition Pakatan Rakyat and Bersih 2.0, the non-governmental organisation fighting for free and fair election have continuously heaped criticisms against the way the agency held elections, conducted the delineation exercise and its inability to remain independent.
Wan Ahmad blamed young Malaysians for the EC’s declining reputation.
“The young would go back home and influence their parents, siblings, friends at stalls and coffee shops,” he said.
“The ones who have been influenced by inaccurate information will make a bad judgment and this does not benefit the country.” – December 1, 2013.

TELL THE PEOPLE: Is it true BN will HIKE electricity rates soon - Nie Ching
Senior director of Energy Commission Azhar Omar revealed at a public forum entitled “Reforms in Peninsular Malaysia’s Electricity Sector” on November 7, 2013 that a hike in electricity tariffs is imminent due to unsustainable subsidies for the power industry, along with worldwide price increases in oil, gas and coal.
Hence, I urge the Government to confirm the accuracy of his statement - whether or not the Government will reduce the subsidies for natural gas in the near future.
If the subsidies reducing policy is imminent, it is proven that the so-called Barisan Nasional Government is nevertheless a “Barang Naik” Government.
Unless your power usage is very low, you will be hit by GST too
Since the 2013 General Elections, the BN Government had increased the price of fuel and sugar. The price of RON95 petrol and diesel were increased by 20 sen per litre effective September 3, 2013 whereby the price of sugar was increased by 0.34 sen effective October 26, 2013, day after Najib Razak tabled the 2014 Budget. If the price hiking of the electricity tariff is true, the people’s livelihood will be overly burdened by such increase.
However, even if the BN Government does not increase the price of the electricity in the next 18 months, its price will still be affected on April 1, 2015, after the implementation of the 6% Goods and Services Tax (GST).
In Najib’s 2014 Budget, he mentioned that the GST will not be imposed on the first 200 units of electricity per month for domestic consumers. In other words, those households whose electricity bill is more than RM43.60 cannot avoid paying the said Tax from April 1, 2015 onwards.
The hiking of electricity tariffs is also the same goes to the industrial and commercial consumers and inevitably it will cause inflation. Most of the businesses will be affected even if their annual sales are less than RM500,000, including mamak stalls and night markets.
On the other hand, the Health Minister, Dr S Subramaniam said that the implementation of the GST will not impact on the healthcare costs. However he is either incompetent in understanding the GST or being denial on the facts that the hiking of the electricity tariffs will certainly affect the healthcare costs, both in governmental and private hospitals. How would the hospital management decide to absorb such a cost?
Apart from that, the government-aided schools will be the victims as well. To date, the BN Government only subsidises RM2,000 for the utility bill of these schools. If the Ministry of Education does not review its policy by April 1, 2015, it will also affect the government-aided schools especially those having excessive amount of students.
So, if there is a cut on the natural gas subsidies and thus increasing the electricity tariffs affecting various fields such as healthcare and education, it is unquestionable that the BN Government is no more but a “Barang Naik” Government.

It's just been announced that the toll for 15 highways in the peninsula will be increased by between 50 sen and RM2 on Jan 1.
Works Minister, Fadillah Yusof the rates have not been adjusted for the last six years. And that...
"The government's contracts with the concessionaires allow for adjustment every three years. If the government does not allow the concessionaires to adjust the toll rates, it has to pay them compensation amounting to RM400 million" ...
What kind of deal did our government make with these companies? If the highway is so lucrative why did the government privatise it? No money to build I think was one reason. With such a win-all-the-way deal any bank will gladly loan a government the money. Right? Cannot lose one ma. So why did our government privatise it?
Can some genius economist please help poor slobs like me to understand ah? Otherwise, life here is getting quite unbearable la.
