Malaysian gov is bodoh!! Once Sarawak joined Malaysia, Malaysian law will be applied lah. Why still refer to British colonial era law? I believe it will be render useless it court, further more Petronas law in 1974 should superceed the older law because it is the latest law passed across the land and sea of Malaysia.
A court battle will be easily won by Petronas.

Maritime lawyer Liu Defa (transliteration of the name) believes that this is precisely the problem with Sarawak’s legal status.
“Sarawak claims that the 1954 Order in Council extended its boundaries to include the continental shelf, which it said was 200 nautical miles from the edge of its territorial waters.
The Order in Council itself did not specify the length of 200 nautical miles because the concept of the continental shelf had not yet been resolved when the Order was issued.
Liu Defa said the term was only properly defined in the 1982 United Nations Convention on the Law of the Sea (UNCLOS), an international treaty that established a comprehensive legal framework for all ocean and maritime activities.
Malaysia signed the United Nations Convention on the Law of the Sea in 1982 and ratified it four years later.
Liu Defa said that after the 1969 state of emergency was lifted in December 2011, Parliament passed the Territorial Sea Act 2012, and the United Nations Convention on the Law of the Sea officially became part of Malaysian law.
He said Sarawak’s claim that the Territorial Sea Ordinance 2012 was passed to correct a boundary error or that the Ordinance was unconstitutional as it was inconsistent with Article 2(2) of the Federal Constitution was baseless.
“Any legislation passed by Parliament into law must be considered valid and enforceable unless struck down by the courts.
“The party claiming that the law is unconstitutional, in this case Sarawak, can challenge it in the Federal Court.”
He pointed out that the 200-nautical-mile limit stipulated by the United Nations Convention on the Law of the Sea was in the interest of Malaysia as Malaysia is a signatory to the international treaty.
“The continental shelf rights along all coasts of Malaysia, including Sarawak, belong to the entire country.
“On this basis, the Petroleum Development Act and the Territorial Sea Act 2012 do not infringe upon Sarawak’s boundaries as claimed and are good laws.
There are many issues involving historical boundaries, state rights and federal powers, and any dispute between Petronas and Sarawak may not be resolved unless the court makes a final ruling.

Battle for oil and gas off the coast of East Malaysia

PETALING JAYA: The battle between Petroliam Nasional Bhd (Petronas) and Sarawak over who owns the oil and gas resources on the continental shelf off the coast of East Malaysia has been brewing for some time.
Section 2 of the Petroleum Development Act 1974 states that Petronas owns all ownership and exclusive rights to crude oil and natural gas, whether onshore or offshore.
Sarawak claims that it owns the resources under the Petroleum Mining Ordinance 1958. The Sarawak government also points out that the Petroleum Mining Ordinance 1958 continues to have legal force and "coexists" with the Petroleum Development Act 1974.
Sarawak pointed out that the specified continental shelf has been within its boundaries since 1954; these boundaries remained unchanged when Sarawak joined Malaysia nine years later.
The dispute is significant because it challenges Petronas' rights to explore in resource-rich areas of the South China Sea, including around the Luconia Shoal.
It is estimated that the region contains 60% of Malaysia's oil and gas resources and is also the main producer of Malaysia's liquefied natural gas (LNG), sufficient to meet 90% of Petronas' LNG exports.
Sarawak is no longer content with receiving only the 5% oil tax stipulated in the agreement and has recently demanded a larger share of oil and gas revenues.
To support its claim, Sarawak says it has sole legal rights to all resources off its coast.
Former Finance Minister Tengku Razaleigh Hamidi said it was not their oil.
He insisted that Sarawak did not have priority claim over the resources compared to Petronas, according to Free Malaysia Today.
“It is not their oil and it was not even discussed at the time (when the 1963 Malaysia Agreement was drawn up).”
Razaleigh, who is also the first chairman of Petronas, said Sarawak should continue to fulfil its responsibilities under the petroleum excise agreement.
"You can't go back and forth, you know, a deal is a deal."

Sarawak's Maritime Boundaries
Sarawak was a British colony until 1963, when it gained independence by becoming part of the Federation of Malaysia.
Sarawak claims that nine years ago during the colonial period, Queen Elizabeth II of the United Kingdom issued the Sarawak (Territorial Correction) Order in Council in 1954 in Parliament.
The Order in Council expanded the territorial waters of the colonies to include the continental shelf, including the seabed and subsoil beneath the high seas adjacent to the territorial waters of the colonies.
Sarawak Parliament Speaker Asfia said this meant that Sarawak's borders already included the continental shelf along its coast when it became part of Malaysia.
“If the federal government’s argument is that Sarawak’s continental shelf has been constitutionally acquired under the Petroleum Development Act, the federal government must compensate the Sarawak government at the market price even if it violates Article 2 of the Federal Constitution,” Asfia was quoted as saying by DayakDaily in October 2019.
Sarawak cites Article 4(3) of Part II of the Federal Constitution as the basis for its claim that the continental shelf was part of its territory when it joined Malaysia on September 16, 1963.
Sarawak also pointed out that Article 2(b) of the Federal Constitution stipulates that any law changing the state boundaries must have the consent of the state assembly and the Conference of Rulers.
Sarawak claims that since these two conditions are not met, any change to its boundaries is unconstitutional and invalid.
This brings up the question of what is a “continental shelf”.

US should change their foreign policy, aim to race their competition to the top instead of racing them to the bottom. It is not an easy task, the world is big enough for US Russia China and all of us. Stop fighting and work together to solve problems may it be, overpopulation, renewable resources, nuclear non proliferation etc. All can be resolved wisely without conflict and wars.
