EU can launch whatever investigation they want but China has a Trojan house in Hungary and BYD building big plants in Hungary, and Mexico is China's Trojan House for USA market.

presently EU already have a 10% tarif on cars make outside EU.

More tarifs is not a sure thing. Germany France may want tarif protections but there are 29 countries in EU...........all don't want cheap cars meh?

BYD may be the largest EV maker in China now. But this may not be forever.

China changes very fast and now there is Aito , supported by Huawei , which may challenge BYD is a year or two. Aito is being manufactured by Cherry and by other companies in future. Huawei intends to support many China EV companies not just Cherry.
