I am writing this open letter to you as a concerned investor in Bursa Malaysia in connection to the closed door virtual meeting hosted by Credit Suisse on the 11am, 2nd Dec 2021 where issues such as ‘modern slavery practices’ surrounding listed companies with the technology sector listed on Bursa Malaysia were discussed.
The aftermath of it was rather obvious and clear by now to all market participants. Following the virtual closed door meeting, some selected few companies which was mentioned in the meeting endured a volatile trading sessions and closed the day lower and as a result, invested investors of all groups be it retailers or institutions had to endure a significant destruction of their holdings on the 2nd of Dec.
While I recognise that the intention was to highlight some of the problems faced by foreign labourers in Malaysia is admirable, it is hugely irresponsible to single out or highlight or target specific publicly traded companies in the closed door call without any corroborating evidence or conclusive investigation shared to the public.
This call also occurred immediately right after ATA IMS’s loss of Dyson’s contract which is still fresh in investors' minds, hence the slightest hint on any companies of improper practices from you will trigger panic selling in the market.
As an advocate of transparency like your goodself, I urge you to share the recording of that discussion and articulate your findings objectively without prejudice to the wider public so investors can make better informed decision when investing.
I also read with interest that you were appointed by Sime Darby Plantation as a member of their Expert Stakeholder Human Rights Assessment Commission in March ’21 and subsequently resigned in July ’21,and also Top Glove as a 'critical friend' in April '21.
If you are able to, it will be helpful if you can disclose whether you have received any compensation from your appointment from those companies.
My concern here is that future ‘wrongdoers’, naturally will consider appointing advocates such as your goodself as a quick fix and treat it as a full absolution of their malpractices.

The border is still closed. Foreign workers recruitment still freezed. I wonder how VS can take the additional orders from Dyson ? Dyson allow them to use illegal workers to support their orders ?
ATA IMS Clarifies Reuters Report, Company Firmly Committed to Wellbeing of Employees and Ethical Practices
JOHOR BARU, Tuesday, 7 December 2021: ATA IMS Berhad (“ATA”) views with great concern a recent report by Reuters titled ‘Dyson splits with Malaysia supplier, stoking concern over migrant worker treatment’, which was published on its website on Sunday, 5 December 2021.
ATA wishes to provide clarifications to the report, which it hopes will help readers to have a better perspective on ATA’s continuous and concerted efforts in addressing and improving its labour and social compliance standard and practices, and ensuring a positive business continuity.
1. Workers’ overtime: • ATA’s company policy strictly adheres to Malaysian labour law, which permits up to 104 hours on normal working days in a month. If workers perform overtime, it is solely on voluntary basis. • The Company pays workers double pay for working on Sundays and triple pay for working on public holidays. • In certain months, which have four (4) Sundays and public holidays, a few managers had allowed their workers to work beyond the number of hours allowed. • ATA views this seriously and has taken remedial measures effective immediately to ensure that this does not reoccur. • The Company has started implementing a zero overtime on Sunday policy; that unfortunately resulted in the resignation of close to 300 local and foreign workers in the first week of December 2021.
2. Work permits: • As of to date, all workers on the premises of ATA have valid work permits. • Challenges with regards to work permits faced by the Company and others within the industry/sector occurred during the Movement Control Order (MCO), when the relevant government offices were running at limited capacity.
3. Coaching of factory employees: • The Company employs 222 supervisors within the entire business unit, who diligently perform their duties to ensure the smooth running of their divisions and the wellbeing of the employees under their supervision. • In reference to Reuters’ reporting, only one supervisor was engaged in a highly uncommon incident of coaching employees on what to say to auditors. • The Company wishes to stress that this is not a company policy and views seriously such non-compliance. • Towards this, remedial action has been taken against the aforesaid employee.
4. Whistleblowing policy and channels: • There are external whistleblowing channels operated by independent third parties, supported by the Malaysian Government and the Company’s Human Resources department. • These channels are in multiple languages; are well promoted and publicised on the Company’s premises; and any reports through these channels go directly to the Company’s customers’ legal teams and the Malaysian authorities. • The Company wishes to state that these complaints were not previously raised through any of these channels.
5. Former worker Dhan Kumar Limbu: • The Company refers to another recent Reuters report with regards to foreign worker Dhan Kumar Limbu, which was published on Reuters’ website on Thursday, 25 November 2021. • The Company wishes to inform that the Johor police has issued a statement on Saturday, 27 November 2021 stating that to date, it has not received any reports regarding the alleged physical abuse by the police of the aforesaid ATA worker. • The Company had also engaged a prominent law firm, which conducted an independent audit. Based on its findings, the law firm concluded that the allegation made by the aforesaid worker is unjustified and unsubstantiated, and unlikely to have taken place.
ATA remains committed to ensuring the wellbeing of its local and foreign workforce as it delivers quality products and services to its customers in over 80 countries. ATA has a Corporate Social Responsibility (CSR) and Environmental, Social and Governance (ESG) compliance audit planned for December 2021. The Company expects to pass this audit, validating its efforts in this area.
Towards this, ATA requests for Reuters to publish our response, enabling its readers and all interested stakeholders to have a balanced view of the issues highlighted in its reporting.

Why not give them Malaysian citizenship of bumiputra status and enjoy more salary and other benefits to make these migrant workers happy to continue working otherwise they will complain to their God father Andy Hall in order to stop our Malaysian products exporting to USA. or UK....
However, the picture was not taken from ATA's worker hostel!
The picture was taken in a hostel on the 2nd floor of a premise in USJ Subang Jaya and the real news was about the living conditions of workers who were fired by unnamed 3 SMEs in Subang Jaya as a result of the MCO in early 2020.
The issue is not about fact-checking before publishing any report.
If fake evidence was deliberately planted and/or taken out of context, the issue will be deliberate sabotage.

Dyson should have backup and planned before announcement.. Not easy to shift all the products to new supplier n supply chain,in 6moths. Asmarket is shortage of components now
VS admitted they use illegal workers! Why Dyson haven't terminate their contract ? If VS makes Andy Hall happy, there will not be any actions taken towards them ?

AT RM0.40 plus, ATAim need to expose Andy Hall and fight him. Another way, Malaysia must try its best not to engage foreign workers. Pay a little higher to Malaysians (East and West). It will solve many accommodation problems.
