I think many people don't understand about PATI Recalibration Program. This is a special program to legalise illegal foreign workers in Malaysia to become legal foreign workers employed by eligible employers. Syndicates claims this as forced labour! Rather than this workers suffer without salary and without a place to stay, Malaysia government is giving these illegal immigrants who wish to work legally a chance to repent.
Thousands of foreign workers and locals losing their job because of this syndicates personal gain. Now Dyson will regret for their hash decision as well ? Is this what you call “Human Rights” to destroy everyones rice bowl ???
If you DON’T give them overtime, they will strike!! If you give them overtime, they will say forced labour!!
If this foreign workers not happy working overtime or not happy with the employer, they should make a complain to their Embassies not to “syndicates” or “activists”.
I’m sure ATA will make press statement very soon to clear all the allegations against them.
Dyson's EBITDA increased by 18% to £1.3 billion (RM7.267 billion) for FY2020.
It's EBITDA/Revenue was 22.81%.
However ATAIMS' EBITDA/Revenue was only 5.98% (lowest compared to VS and SKP). The low margins were probably due to pricing squeeze and dependence on Dyson.
ATAIMS, VS and SKP all have EPF/Salaries ratios of less than 12%, indicating high percentages of foreign workers in the industry.
Where can Dyson switch to when ATAIMS was already the lowest cost supplier???
MrsLim, totally agree with you. ATA do not have any major issues with Dyson. I guess every companies in the world have foreign workers issues which can be solved.
Every problems, there is a solutions.
All this syndicates and activists have their own agendas. They just want all this public listed companies to appoint them as advisor or to be the board members in their companies after the allegations which created by them.
Hall stood by his claim that “ATA IMS is by far one of the worst companies with regard to the systemic forced labour issues that have been detected in this (EMS) industry.”
“The situation at ATA is indeed far more critical for example than the situation at some other plastics and mounding manufacturers in Johor Bahru that also have their own migrant labour social compliance challenges,” he pointed out in a statement in response to questions by The Edge regarding his participation in the Credit Suisse event.
Confirmed death of ATA on Forced Labour.
VS are in good talk to Andy Hall with the hope that he drops VS in all Forced Labour topics. Therefore today VS is green green up 12 cents. Andy is in Johor Bahru, happy with VS bosses now.
How about SKP ? They sure rush to see Andy too, as ATA, SKP & VS are brothers in Dyson business. But Andy has yet to meet up with SKP, whether will they meet? unknown yet, so SKP falls 13 cents .
Look at ATA and SKP prices, when Andy in Johor Bahru, you know who is winner and who is loser. I am very sure, I am. FFFF, i still got lots of ATA shares after i cut position twice.
Who caused forced labour to ATA ? Its known fact to Dyson as they pump and pump orders and forced ATA to produce to deliver, despite the fact that ATA has revealed facts that they are in short of labour due to MCO, yet Dyson never bother to press super heavy to ATA management.
You know, as ATA Singaporean boss and Indian man, they just care their pockets, they of course happy to see these happy problems of significant increase in orders. so, poor workers work no day no night, but i believe they are PAID WELL too. They are more than happy to earn more than 5K per month on OTs. They know it could be just these few months only as after MCO , new migrant workers will be coming in.
Forced Labour Issue ?? I think those 3rd world countries may be yes, not Malaysia.
Hero Hall and his so-called group of abused migrant workers may have won the battle this time but bear in mind, they all too wud be facing a hard and diffucult moment soon when lay-off starts to kick in especially at bad times like now...
PRESS STATEMENT / SIARAN AKHBAR (FOR IMMEDIATE RELEASE) JOINT STATEMENT BY VS AND MIGRANT WORKER RIGHTS SPECIALIST, ANDY HALL, WITH REGARDS TO WORKERS’ WELFARE • Andy Hall stresses that further independent third party audits and credible investigations are needed into the situation of migrant workers in Malaysian industries. • He currently has no intention to launch public campaigns against any specific companies that are open to constructive dialogue on migrant worker rights. • Both VS and Andy Hall are in discussion on areas of fruitful cooperation into the future to enhance the welfare of migrant workers at the company. Johor Bahru, 6 December 2021 – Leading Electronics Manufacturing Services (“EMS”) provider in Malaysia, V.S. Industry Berhad (“VS” or the “Group”) (“威鋮 集团”) has proactively reached out to Migrant Worker Rights Specialist, Mr. Andy Hall, following references made to VS by Mr. Hall during a recent investor briefing on the topic of migrant workers’ welfare in Malaysia. Following a discussion between both parties, Migrant Worker Rights Specialist, Andy Hall commented, “I continue to mention in my capacity as an independent guest speaker at conferences and investor briefings that there is a need to conduct further due diligence with regards to the situation of migrant workers at suppliers of many MNC brands in Malaysia. My areas of concern include the legality of the use of outsourced migrant workers through third party agents, the risks inherent in the government’s recalibration scheme as well as working hours, living wage and social dialogue issues, amongst others. However, my recent comments were not meant as a direct reference to indicate irremediable migrant worker issues at VS.” “At this juncture, I have no intention to launch further public campaigns against any specific companies that are open to constructive dialogue on migrant worker rights, given the inherent risks of publicity to the well-being of all concerned, especially the workers and their families. It is also important to ensure migrant workers’ livelihoods are sustained, while not compromising their welfare. It would not be an ideal situation if in the end, any workers, whether Malaysian or migrant, lose their jobs due to exploitation of situations that could and should be remedied.” “Nevertheless, I do believe my concerns are valid and should be treated seriously by companies, the government and investors in Malaysia and globally. Hence, I urge both suppliers, buyers and brands to urgently remediate serious social non-compliance issues and ensure a much needed strengthening in the overall sectoral and corporate approach to engaging and improving social compliance, as the ‘S’ is often left behind in the ESG concerns for the industry.” “In this regard, I am happy that the management of VS share my concerns and we are already in discussion on the subject of migrant workers’ welfare following the company’s effort to proactively reach out to me so I could share my concerns with them. I have offered my immediate suggestions for VS’s management to consider. I look forward to further exchange of communication with VS leadership that can surely bring win-win outcomes to both migrant workers and VS,” Mr. Hall added. Managing Director of VS, Datuk S.Y. Gan (拿督颜森炎) said, “At VS, we place high priority on ESG matters, and are committed to maintaining our high 2 standards of corporate governance. On the subject of migrant workers, we are serious in our efforts to safeguard the legitimate rights and interests of all employees, including migrant workers. Obviously, managing a large pool of migrant workers indeed comes with challenges. As such, we have experienced and trained personnel in-charge of the management of migrant workers.” “We are in compliance with all government regulations with regards to our migrant workers. We have also passed the latest audit checks by the Responsible Business Alliance or RBA, as well as by our key customers with no material issues highlighted. Notwithstanding this, we acknowledge and appreciate the concerns brought up by Andy Hall, and we understand where he is coming from. In response, as a transparent and responsible corporate citizen, VS wishes to once again stress we are open to working with external parties including civil society who can add value and further strengthen our ESG initiatives, including as regards enhancing the welfare of migrant workers.” “With our operating history of over 40 years, VS has established a strong reputation with our MNC clients. As such, it is certainly in our best interest to ensure all our practices are above board to uphold our reputation with our clients and build long term relationships with them.” Datuk Gan concluded. About VS VS is one of the top 5 Electronics Manufacturing Services (EMS) corporations in ASEAN, as well as one of the top 50 EMS in the world, providing vertically integrated manufacturing solutions to
multinational corporations across the globe. It has advanced manufacturing facilities in Malaysia, Indonesia and China. Backed by a team of highly skilled and innovative R&D personnel, VS also serves as an Original Design Manufacturer (ODM) in addition to being Original Equipment Manufacturer (OEM). Its comprehensive services include 3 4 high-precision printed circuit board assembly, plastic injection moulding, suband full- assembly as well as tool design and fabrication. Ask the Singaporean and Indian of ATA to knee down to Andy Hall to beg him and then they can save all retail investors here...as Andy is in Johor Bahru or Singapore ...LU of ATA.... Cheers
"My areas of concern include the legality of the use of outsourced migrant workers through third party agents, the risks inherent in the government’s recalibration scheme as well as working hours, living wage and social dialogue issues, amongst others." - Andy Hall
Almost all EMS corporations in Malaysia have been audited by the Responsible Business Alliance (RBA), a body widely engaged by electronics firms to conduct factory audits.
If the those corporations have passed the audits by RBA, who is Andy Hall to say otherwise and what gave him the authority to launch unilateral attacks on those companies?
The areas of concern regarding 'outsourced migrant workers through third party agents' and government’s recalibration scheme are structural and public policy issues that impact almost all industries in Malaysia, ranging from domestic helpers, manufacturing, security guards, construction, retail, restaurant, etc.
On the issue of long working hours, what is the percentage of foreign workers who is against overtime jobs? Has anyone been forced to work against their will? Are all the workers' passport being held by agents?
As to the living conditions, the following pictures will show the external environment of an ATA IMS hostel vs a PPR flat in Malaysia. Who has a better living environment?
Ultimately, it's puzzling on how can a 'flagged' corporation solve all the structural and public policy issues just by reaching out to an activist?
If by kow-towing in to a self-named and self-styled activist can be a solution to structural problems that cannot be solved, then more activist hedge funds, 'hushmail', greenmail and blackmail will appear. And they will be better funded and more aggressive.
VS or SKP are not interested to take over Ataims contract due to very low margin and they don't like dictatorship style of Dyson, so either Dyson have to pack up from Malaysia and go to Nepal or Bangladesh to get the supply as these two country have a better human rights establishment.. Hahaha.
Dyson is regretting termination of contract from Ataims as Ataims management will not bend down to his dictatorship manner, that's why he send Andy Hall to VS begging VS to take over Ataims contract but VS or SKP are not interested at extremely low profit margins..
Just wondering why this Andy Hall so concerned about foreign workers here? Why don't he take a look at the issues of labour in say Bangladesh, India, Nepal act ? Who actually pay him? Surely he does not do it out of good intention using his own money, after all he has to earn a living and he has a good and expansive lifestyle to fund unlike the typical cheap labour!
oskchoon VS or SKP are not interested to take over Ataims contract due to very low margin and they don't like dictatorship style of Dyson, so either Dyson have to pack up from Malaysia and go to Nepal or Bangladesh to get the supply as these two country have a better human rights establishment.. Hahaha. 07/12/2021 10:30 AM
Ataims is making it's own brand of home appliances soon with colaboration from China company ..to export to China markets as Ataims already has the technical know how.
Dyson technology improvement depends on Ataims engineering team and Ataims will use it to work as High Technology Home Appliances manufacturer instead of Supplier.. .
Andy Hall has attacked Thai pineapple company Natural Fruit; petitioned to US Customs and Border Protection (CBP) to investigate Hartalega and Supermax; and now made sweeping allegations towards Malaysian EMS companies.
The most important question is whether his initiatives have created more good than harm and do they address the fundamental problem.
There have been numerous documentaries on modern slaves in Britain. Shouldn't Andy Hall focus on his home country where tens of thousands of have been smuggled into the country, and forced to work as slaves against their will.
"Bad move, Dyson. When you identify a problem in your supply chain, disengaging w/ the supplier is the *opposite* of what you are supposed to do. Due diligence means engaging to improve the conditions, not cut & run which can cause thousands of job losses" - Anna Katrin Cavazzini (a German politician of the Alliance 90/The Greens who has been serving as a Member of the European Parliament since 2019)
This book is the result of the author's many years of experience and observation throughout his 26 years in the stockbroking industry. It was written for general public to learn to invest based on facts and not on fantasies or hearsay....
