The fact is 1) High Court's verdict based facts and witnesses that MSIG must bear the liability
2) Appeal Courts-- 3 judges agreed that their is No technical errors in High Court's judgement

What do you think Federal Court is set for-----for AhLoong to appeal if he cannot collect his Debt??

90% of the time Federal Court takes ONLY case like Death Penalty, Life imprisonment, Politicians stealing money, Immigration Rights, Citizenship , Cases link to Federal Constitution, Big Corporations Fight with Federal Gov or among themselves

You can count with your fingers how many Federal Courts Judges there are.....
( Federal Court will accept your case Or not-----most likely ended in case mangement for

Sebabnya otak rosak punya orang selalu cakap hal yang berlawanan.
Last time thank to samngks (otak rosak no1) everyday or every hour came here put negative comment , then i 100% confirmed win case for dps.

Pls read my earlier comment to TY828 where I said "it is possible that both parties do not want to fight on and they negotiate for settlement. In that event, this matter will be close fast and DPS will get the money fast" This I view as positive for DPS. So you are wrong one time.

Now u say I am no. 2. So now I am no longer the samngks that u presumed earlier. So u are wrong the 2nd time.

Does 2 wrongs make 1 right?

Final Result Of Court Case on 22/4/2016:9am as:-
1.The Appeal is allowed in part..
2.The decision of the HCJ in so far as her finding on liability of Appeliant under the 3 takaful policies are concerned,even applying the balance of probabilities standard of proif is affirmed..
3.However,the appellate intervention is required in so far as the Learned Judge's finding on quantum are concerned..
4.Therefore,the appeal on quantum is allowed and the case is ordered to be remitted back to the High court for re-asseseement of damage before another HCJ with liberty to both parties to adduce all relevant evidence for the purpose of assessment of damage..
5.The intersent on judgement sum at the rate 5%p.a. from 14.7.2011 until full realisation as ordered by the HCJ is maintained..
6.The decision of the HCJ date 26.9.2014 is hereby set aside to the extent stated above..
7.The agreed cost of RM50,000 be rewarded to the appeliant..
8.The money deposited in the respondent's solicitor's interest bearing account pending the disposal of this appeal be refunded to appliant within 7 days from today's date..
9.The deposit of appliant to be refunded..

ngch, my unsolicited advice. DPS downside is limited to 0.10. Upside potential is many times the downside risk. If anyone can't stomach the risk, go play FD. Those crying wolves, they are just immature punters who wet in their pants at the slightest 0.005 drop. Nobody asking them to sell house sell car to buy, buy only with extra saving and that is limited to the amount you are comfortable with. If you are able to hold steady, you will realize that these jokers who kept shouting down or sell, they are just bunch of losers.

Get into the bus early. At worst case scenario, you lose 1 sen but it's easily recoverable. Just don't miss the bus as once it starts to climb for real. Even to get a good rate FD, you still need to park your saving for a minimum of 6 months. And if you still need to think about it, this trading business is not suitable for you.

The case is sent back to High Court for "review on the quantum of payment" (liability still intact which
means regardless what happen msig got to PAY----------it cannot be zero as some idiot's suggested)
Both parties will fight on the 19million award with "OLD data" ( previously submitted)...No new data
are allowed bcoz appeal judge didn't instruct a new case to be opened......I think only ONE day is enough...

The new quantum "check" got to be deposited into DPS's lawyer account again pending
whether Msiq wants to appeal to Federal Court.....( If MSIQ lawyer is confident of winning, they
should request Appeal Judge to transfer case to Federal Court instead of going back to High Court
for review on quantum bcoz if the new HCJ maintain a stay on 19m award then there is NO way
Federal Court will have a different Opinion---always the case )

As I said many times before the Original Judge is a member of the Appeal Court panel --He doesn't
made stupid Judgement------The judgement on 22 April by (3) Appeal Court judges agreed with the original judgement...........If the case is sent to Federal Court, the Federal Judge also looks for dispute
between High Court and Appeal Court.....if there is None ......why waste time....

Because if MSIG appeal to the Federal Court on the issue of liability and if MSIG win (and thus the COA and High Court decision overruled), that mean MSIG is not held liable for the insurance claim (in other words, they are not responsible for the fire claim) and hence MSIG does not need to pay DPS. That is the purpose of appeal, to overrule the lower court decision.
Otherwise why do u think MSIG appeal to the Court of Appeal in the 1st place."
