Guys, the claimant is suing for RM796k LAD and RM120mil for loss of profits. Anybody who understands contract suits & civil procedure will know that loss of profits are VERY rarely awarded. Susah to prove and too remote for the arbitrators to issue an award. How can they prove those profits will be earned? Was it foreseeable when the contract was entered into with EMSB? How is it quantified? etc.
Claimants usually do this to scare the other side into settling.
EMSB's claim OTOH appears to be for work carried out but not paid for. It was made before IRDK's claim. Sure looks like IRDK is trying trump up a lawsuit to pressure EMSB.
IMO, this claim is unlikely to succeed. EMSB will resolve this and those of you who panicked today......well, jangan susah hati la.

I don't think the developer has a strong case. If they have a strong case, they would have sued first
