INTRODUCTION The Board of Directors of IJGB wishes to announce that the Company had today been served with a Writ of Summons dated 3 October 2019 (“Writ”) and Statement of Claim dated 2 October 2019 (“SoC”) by the solicitors of the Plaintiff. 2. Details of the circumstances leading to the filing of the Writ and SoC The Plaintiff, IJGB and Ikhmas Jaya Sdn Bhd, a wholly owned subsidiary of IJGB (“IJSB”) had entered into a Memorandum of Understanding wherein the Plaintiff and IJSB have been invited to participate in a proposed project known as Rancangan Tebatan Banjir Sungai Pendang, Kedah Darul Aman: Menaiktaraf Sungai Choras/Sungai Sala dan Struktur-Struktur Serta Kerja-Kerja Berkaitan (“the Project”), as a subcontractor by forming a joint venture to carry out the works under the Project in the event that IJGB is awarded the Project. Jabatan Pengairan Dan Saliran Malaysia had via the Letter of Acceptance of Tender dated 9 April 2018 awarded the Project to IJGB as the main contractor. The Plaintiff and IJSB had formed an unincorporated joint venture for the sole purpose of undertaking the execution and completion of the Project. For the purposes of preparing and submitting its tender for the Project, the Plaintiff had agreed to grant a friendly loan of RM1,500,000 to IJGB (“the Loan”). IJGB had made part payment totalling RM150,000 towards the repayment of the Loan. The balance of Loan totalling RM1,350,000 remains outstanding and payable to the Plaintiff. 3. DETAILS OF THE CLAIM The Claim made by the Plaintiff against the Defendant are detailing below:- (a) Total Outstanding Sum amounting to RM1,350,000.00; (b) Interest on the Judgement Sum at a rate of 5% per annum from the date of this action until the date of full and final settlement; (c) Costs; and (d) Such further and other reliefs as the Court deems fits and proper to grant. 4. FINANCIAL AND OPERATIONAL IMPACT The Claim is not anticipated to have any significant financial and operational impact on the Group’s results for the financial year ending 31 December 2019 since the abovementioned amount has been accrued for in the financial statements. 5. DIRECTORS’ AND MAJOR SHAREHOLDERS INTEREST None of the Directors and/or Major Shareholders of IJGB and/or persons connected to them have any interest, direct or indirect in the Claim. 6. Not counting the latest material litigation, there's already 8 cases in the last quarterly report. Moving forward, judging from the trend, the directors and company have no choice but keep disposing shares to survive, not sure whether my observation is right or not.
Ikhmas Jaya: Served winding-up petition by Ipmuda for owing RM3m. Ikhmas Jaya Group and its wholly-owned unit Ikhmas Jaya SB (IJSB) have been served with a winding-up petition from Ipmuda for owing RM2.97m. The sum is the amount owed for the goods delivered and services provided by Ipmuda.
