Azmin asks for Najib’s help in Selangor water deal

Prime Minister Datuk Seri Najib Razak is expected to mediate in the Selangor water impasse between the state and federal governments, to find an immediate resolution, Menteri Besar Mohamed Azmin Ali said today.

Azmin said that he has asked Najib to intervene in the matter, which saw Selangor denying Putrajaya a third extension on the water restructuring deal that lapsed on Monday.

"I conveyed our concern on behalf of the state assembly to the PM when we met this morning at the Rulers conference," the Gombak MP told reporters in Parliament today.

"I have asked the PM's help to inform the ministry (Energy, Green Technology and Water Ministry) that we have to find an immediate resolution so that the problems can be resolved."

The menteri besar said Najib had responded favourably to the suggestion to mediate in the impasse, after Azmin expressed hope that the issue would be resolved in the near future.

"I hope that we (Selangor and Putrajaya) can sit down sometime next week (to discuss this). I told the PM that the ministry has to hold on to the spirit of understanding and that the master agreement cannot 'depart' from that principle.

"If you keep on changing the goal post, very hard for the state to follow," he added.

Selangor had revoked the controversial water agreement with Putrajaya inked by Azmin's predecessor Tan Sri Abdul Khalid Ibrahim in September last year.

In doing so, Azmin said that the federal government had failed to comply with conditions set by the state government.

“They (federal government) breached the agreement and did not honour it,” he said.

This had included Putrajaya's request for the land where water pipes would be laid, which Azmin said would result in Selangor giving up sovereignty over its land.

But Energy, Green Technology and Water Minister Datuk Seri Maximus Ongkili said the request for land was to lease it for 45 years, while his deputy Datuk Seri Mahdzir Khalid said the land was meant to be collateral for the RM2 billion that Putrajaya would give the state to help it take over four water concessionaires as part of the restructuring exercise.

The Selangor government had twice extended the deadline for Putrajaya's compliance – January 9 and February 9 – but the federal government had asked for another extension.

Ongkili told The Star today that the matter would be resolved in court if both the state and Putrajaya failed to come to an agreement over the matter.

However, Azmin said today that legal means would be the state's last resort to resolve the water impasse.

"I am sure we can sit down and discuss," he added. – March 12, 2015.

get off your bum, pause posting on i3investor and install a Rainwater Harvesting System laaaaa!

I already have one installed so I can cakap besar and am unconcerned about water rationing here. So have a few of my friends.

I'm not sure if anyone realise but we live in the Malaysia, not the Sahara. There is rainfall aplenty that you can collect for toilet, clothes and dishes.

Azmin hopeful negotiations on stalled water deal can resume next week

KUALA LUMPUR: Negotiations on the stalled water deal between the Selangor state government and Putrajaya could resume next week.

Selangor Mentri Besar Azmin Ali said he had met Prime Minister Datuk Seri Najib Tun Razak on the sidelines of the Conference of Rulers on Thursday and had stated his wish for an immediate solution to be found.

Both Azmin and Minister of Energy, Green Technology and Water Datuk Seri Dr Maximus Ongkili had earlier expressed a desire to resume negotiations on the water agreement.

“The Prime Minister has given his assurance that he will speak with the Energy, Green Technology and Water Minister regarding it,” Azmin told reporters after a closed-door Pakatan Rakyat meeting in Parliament on Thursday.

He added that he hoped the ministry and Selangor state government could resume discussions on the issue sometime next week.

(雪蘭莪‧八打靈再也11日訊)雪州水供協議的爭議再起,能源、綠色工藝及水務部長拿督斯里麥西慕和雪州大臣阿茲敏阿里各執一詞。若這項水供重組計劃繼續再拖延或告吹,將對雪州人民帶來3大影響;雪州也可能在2017年面對大水荒。

大馬水務與能源研究協會(AWER)高級經理林素芳警告,雪州水供協議再起爭議,人民肯定是最後的輸家。

因此她促請中央及州政府公開雪州水供重組主要協議內容,以把所有條款攤在陽光下,由大眾去評估誰是誰非,也監督合約的執行。

該協會也促請中央政府和雪州政府勿再對此協議爭議不休,雙方應坐下來好好談,以免犧牲人民的利益。

水費漲鬧水荒……拖延協議有3後果

若雪州水供協議受到拖延,可能造成的4個後果如下:第一:目前四家私營化水供公司將可以按照原本合約條款調高水費。

林素芳說,由於政治因素,雪州的水費調漲問題,暫時被擱置。一旦水供重組計劃告吹,很難要求這些私營化公司透明化他們的營運成本,加上他們至少還有十餘年的特許經營權在手,未來十多年,這些公司就可以按照合約條款調漲水費。

第二:無收益水問題無法解決,水供公司成本轉嫁給雪州用戶。

她說,雪州有很多陳舊的輸水管,一年浪費了很多的無收益水,而在有關的合約中,本來是要減少無收益水的問題,但若無法成事,更換陳舊水管的計劃又要被擱置,無收益水問題沒有解決,水供公司又得面對這筆損失,但羊毛始終會出自羊身上,料最終水供公司將把這筆損失轉嫁給用戶。

第三:隨時面對水供短缺風險她指出,在該合約中,雪州政府將批准土地的使用,讓中央政府建造冷岳河二濾水廠,但如果合約告吹,冷岳河二濾水廠就建不成。本來預計在2017年的時候,冷岳河二濾水廠,每日預計的食用水生產量是11億3千萬公升,供應給雪州南部和吉隆坡地區的用戶。

目前雪隆每日所生產的食用水是46億公升,而雪隆人民每日的需水量達到了該數字的95%,州內只剩下5%的淨水儲備量,已經達到飽和,萬一發生大型輸水管破裂、水源污染或如去年的長期氣候干旱,雪州人民就會面對水供不足的問題,重演過去的歷史。

她認為,咖啡山和士毛月水壩的水務資產,是由中央政府撥款建造的,所以應該屬於中央政府所有,但是土地則屬於雪州政府。

她補充,每一個州的土地都是屬於各州政府的管轄權力,除了一些特別的地方是屬於中央政府之外。

指阿茲敏“雞蛋裡挑骨頭”

針對中央政府和雪州政府目前爭議的協議中,屬於中央的水務資產管理公司(PAAB)所接管的雪州水供公司等各造的資產,是否有包括水管所經過和裝置的土地時,她說,在這個課題上,雪大臣阿茲敏阿里顯然在“雞蛋裡挑骨頭”。

她說,就好比建屋子不可能不建在土地上的情況一樣,中央政府要接管的這些水務資產,如濾水廠、水壩,也是建在土地下或土地上的,不可能是建在空中,所以在有關的協議中,這些土地也應該是屬於中央政府的。

她說,在有關的協議中,雪州有96億5千萬令吉的負債資產,當中有20億令吉是用來收購4家水務公司,還有76億5千萬令吉的水務資產債務。而雪州政府的雪州水務私人有限公司(Air Selangor Sdn Bhd,ASSB)要解決這筆債務,就要把價值96億5千萬令吉的資產暫時交給PAAB作為抵押,這是很公平的程序。其他已經進行水務重組的州屬包括檳城、霹靂、柔佛及森美蘭都是如此。

她說,既然在協議中要把資產暫時抵押給PAAB,那這些土地就暫時不屬於雪州政府所有。

合約滿土地歸州政府

她說,據瞭解,雙方也簽署了一份長達45年的租賃合約,在這項合約內,ASSB每年就會依據合約內容,固定償還多少的貸款給PAAB,一旦約滿,還清債務,這些資產就會歸還給雪州政府。

“這表示45年後,ASSB沒有負債以後,這些土地就會屬於州政府。”

不過她表示,為了消除阿茲敏阿里的疑慮,在轉移資產給PAAB的協議上,雪州政府可以附加一個條款闡明,“水務資產所在的土地,也會一併租給中央政府,不過是零收費。”

土地租賃中央零收費

她解釋,為何租賃土地給中央政府又不能收費的原因,是因為96億5千萬令吉的債務是由人民的水費中支付,如果租賃上述在水務資產上的土地還要收費,表示雪州水務債務會更高,那這筆費用最後還是由人民去承擔。

無論如何,她說,目前雙方簽署的是水供重組計劃主要協議(Master Agreement),這表示裡面的條款,需要雙方一致同意了,才算是正式生效。相反的,如果這裡面有任何的條款無法兌現,表示可以取消這個協議。

林素芳說,若雙方不清楚各自在這個水供重組合約中的責任與角色,該如何重組雪州的水務業,該協會樂意開班授課,把他們各自的角色解釋得一清二楚。

If keep delay ask for higher compensation because time is money. Eg O&G(one of possible new Puncak business) counters(eg Alam, Barakah) no more cheap like 2 months ago.

the fed have money to help 1mdb but don;t have money to help solve the water deal by offering splash of 1x book value similar to other water player.
if they solve the splash deal first, then i think the puncak deal will be easily close.
now this puncak deal is hanging bcos of splash. The land issue may not be the real reason.
State gov would want to resolve both deal together. If they approve puncak deal , then they will be have a tough time to negotiate to close the splash deal later.

pkr is doing the right thing. Don;t blame on them. It is part of the negotiation strategy.

jolie, azmin is definitely not doing the right thing. if he is sincere about resolving this, he should have stated clearly the conditions, rather than a last minute call off with some stupid reason, of course, only if I am getting the picture right.

Off The Cuff - Water politics enters chronic stage

THE hopes of millions of people in Selangor, Kuala Lumpur and Putrajaya – Malaysia's most highly populated regions – for an end to one water supply crisis after another were dashed this week as Selangor's water politics enters its most chronic stage.

It came when Selangor Mentri Besar Azmin Ali declared on Monday that the master agreement signed between the state and federal governments in September last year on the restructuring of the state's water industry had lapsed and would not be renewed.

He accused the federal government of breaching the terms of the agreement and as two extensions had been given for compliance with the deal, there won't be a third extension although there's still room for negotiations to revive it.

So for the moment, as far as the Selangor government is concerned the deal has collapsed, as Azmin told Parliament the federal government had reneged on the agreement by demanding free land on which 26,000 km of pipes belonging to the water concessionaires have been sitting on.

But apparently, Azmin told only one side of the story as Datuk Seri Maximus Ongkili, the energy, green technology and water minister, revealed that the Selangor government had not kept its side of the deal.

In denying that the federal government had breached terms of the agreement, Ongkili said it was delayed because the state government had yet to resolve the transfer of assets to Pengurusan Aset Air Berhad (PAAB) for it to set aside RM1.68 billion to cover the costs of taking over the four water concessionaires in the state.

Besides this, the state government's special purpose vehicle Pengurusan Air Selangor Sdn Bhd has failed to complete the transfer of assets from the concessionaires to PAAB as a repayment to PAAB over their liabilities worth RM7.65 billion.

In other words, it's not as one-sided as Azmin has made it out to be and he needs to explain why on the Selangor side, the points raised by Ongkili were yet to be complied with as in any agreement, it takes both sides to tango.

Surely such an agreement cannot be unilaterally revoked.

Ongkili further disclosed that contrary to Azmin's claim, the land on which the pipes have been laid across was included as part of the assets listed in the master agreement which says that the assets include the land above and below the pipes.

The agreement only covers the pipelines and assets and does not include state land as we have been told by Azmin.

Ongkili explained: "There seems to be some confusion here. When the state government submitted a list of assets as part of the conditions in the master agreement, we found out through the Federal Land Commissioner that some of the assets are on federal land. We pointed this out but was challenged by the state government. Due to this, the master agreement is yet to be in force."

What Ongkili said makes a lot of sense because just like the Keretapi Tanah Melayu railway tracks that cut across the route to Singapore, KTM used to own the land on which the tracks are laid before the train service was terminated two years ago.

And both the Singapore and Malaysian governments have signed a deal for joint development of the land.

As an editorial in the New Straits Times points out, if Azmin's decision is not an attempt at politicising the water issue again (after the deal was signed), then what is it?

In this column, which I started in August of 2011, I have written at least a dozen times on Selangor water politics to highlight the debilitating implications of prolonging the obsession of politicising water, our most vital basic resource.

Azmin's predecessor Tan Sri Abdul Khalid Ibrahim spent most of his six years in office doing this when soon after becoming mentri besar, he started eyeing the takeover of the water assets privatised earlier by the then Umno-led Barisan Nasional government.

He did this because of what he described as "lop-sided agreements in favour of concession companies (that) have placed the people on the losing end for so long and this has to stop."

Khalid's view on this is highly debatable. Water tariffs in Malaysia, for the kind of international standard and quality that we are blessed with coming out of our taps, are the lowest in the world and way below the cost of production and maintenance.

And in a highly populist move as part of the water politics, Khalid introduced free water for the first 20m³ of consumption for households, the only such policy in the world.

It's free for these consumers but costly for the state government as it has to pay at least RM11 million monthly to the water producing concessionaire.........http://www.thesundaily.my/node/299815

Selangor, residents to lose out if water impasse unresolved, says Khalid -

Selangor and its people will be on the losing end if the state government fails to work things out with Putrajaya over the water restructuring deal, called off earlier this week, said former menteri besar Tan Sri Abdul Khalid Ibrahim.

Khalid, who had signed the controversial water agreement with Putrajaya last year when he was MB, warned that Selangor could also lose the opportunity to take over other water concessionaires.

"This includes the risk of losing the opportunity to take over the equity of four water concessionaires that have been milking sinful profit from the people based on a lopsided agreement, which failed to put the people’s interest as priority," he said in a statement today.

He said that the state government would not be able to continue its 20 cubic metre free water programme due to the lack of funds if it did not have full control of the water industry.

"This will also allow the concessionaires to execute the concession agreement, which would cause water tariff to increase by 52% in 2015. To make it worse, the state will have to pay water tariff increment arrears amounting to more than RM2 billion.

"It obvious that Selangor has so much to lose if it does not resume talks with the ministry and I hope that the state leadership will put the interest of the people before taking their next course of action," the Bandar Tun Razak MP said.

Khalid revealed that he had met with the Energy, Water and Green Technology Minister Datuk Seri Maximus Ongkili, who had assured him that the federal government was committed to implementing the water deal, for a "holistic restructuring" of the state water industry.

"On behalf of the people of Selangor, I call upon the federal government and Selangor state government to work out their differences to make for the implementation of Head of Agreement signed last year.

"I believe that the land ownership issue – which was cited as the reason for the state government to nullify the agreement – can be solved if all arguments are worked out at the negotiation table," he added.

"The people must also take note that the price for the equity takeover of the four concessionaires must not exceed RM9.65 billion as previously agreed. Any price above that is akin to robbing the rakyat’s resources to enrich the greedy concessionaires."

Khalid was sacked from PKR last year over a host of reasons, which includec his decision to secretly sign the water-restructuring deal with Putrajaya, without consulting Pakatan Rakyat leaders.

Apparently, State is now asking Puncak to grant extension again, from 9 March 2015 till 9 April 2015, which is contradicted with what MB, Azmi said earlier to allow deal to lapse.......but he master agreement is irrevocable......a proven politicizing act.

With PM (head of fed gov) to lead the deal, MB (head of state) will not have any excuse to delay any longer

the land matter is insignificant should they really want to address. If politicians prefer politicizing the issue, why bother letting them have the fun to show off?

State request for extension have not approved yet by Puncak. This is because, Puncak will have broad meeting to deliberate on state request for the 3rd extension of time, I believe after fooled by MB, Azmi on his earlier politicizing act, board of director should seriously make firm and clear that 3rd extension until 9 April is FINAL extension and MUST seal the deal,

or otherwise Puncak have right to terminate the deal completely and all consequence should be bear by state, including state violate SPA, master agreement is irrevocable, legal action will be taken and Puncak can submit these state official SPA and take over offer document to the high court as latest valid evidence to show that all outstanding debt and receivables incur by Puncak resultant from state failure to grant water traffic already now recognized by state and state is willing to pay compensation for Puncak equity interest RM 1.555 bil + absorb all debt. Even though state eventually fail to seal the deal, but the SPA and take over offer document is state official and legal document, therefore, it is still contribute a valid evidence and allowing court to expedite current ongoing legal case against state and for court to grant favor to Puncak in which state will have to pay water tariff increment arrears amounting to more than RM2 billion.

with najib take over to lead the deal, i think this puncak deal will have closure. Najib will show-off that he have a "Big Heart" and willing to compromise for the sake of selangor people for the purpose of winning back selangor in the next election,

If the deal not close, (although the media said it is pkr fault) it still not help BN to win in the next election

I bet this puncak deal will close together with Splash getting 1x book value with najib leading the deal as the world / investor is watching how najib can safe face (due to many issue from 1mdb).

for khalid, he is a history now and he should shut his mouth off.
