Putrajaya wants Selangor Menteri Besar Mohamed Azmin Ali to explain why he cancelled the agreement made last September to restructure the water services in the state.

Energy, Green Technology and Water Minister Datuk Seri Dr Maximus Ongkili in an Utusan Malaysia report today said the ministry was waiting for an official letter from before taking the next course of action.

"We will wait for the official letter from the Selangor government and its explanation for refusing to extend the water agreement," he was reported as saying in the Umno-owned Malay daily.

It was reported yesterday that Selangor had revoked the controversial water agreement with Putrajaya inked by Azmin's predecessor Tan Sri Abdul Khalid Ibrahim in September last year.

Azmin told reporters in Parliament that the Federal Government had failed to comply with conditions set by the state government.

“The agreement (water deal) lapsed today (Monday), we (the Selangor state government) are not going to extend it.

“They (Federal Government) breached the agreement and did not honour it,” he was quoted as saying.

The Selangor government had extended twice the deadline for compliance – January 9 and February 9 – but Putrajaya was said to have asked for another extension.

Meanwhile, Water and Energy Research Malaysia president S. Piarapakaran in the same report by Utusan Malaysia said the state government should have discussed the matter with Putrajaya before deciding to cancel the project.

He said Selangor residents too have the right to know the reason why the state government had refused the extension.

"With the end of the deal, users in the Klang Valley will feel the impact because at the moment, the treated water reserves are still low," he said.

"Don't just argue and make harsh decisions without consultation because this issue involves the interest of the people." he added.

Last year, Azmin urged the federal government to disclosed the details of the water deal in order to explain to the public how the deal would impact them.

But, Ongkili was reported as saying that the ministry would not disclose the contents of the water deal, after legal advice from the Attorney-General's Chambers. – March 10, 2015.

MB: Perjanjian batal demi kedaulatan S'gor

Menteri Besar Selangor, Azmin Ali menegaskan bahawa perjanjian penstrukturan air di antara Selangor dan kerajaan Persekutuan lupus secara automatik apabila kerajaan Persekutuan cuba mengambil alih 26,000 kilometer persegi tanah Selangor.

Menurut Azmin, perjanjian yang ditandatangani pada 12 September 2014 sebelum ini hanya melibatkan pemindahan aset air dari Selangor kepada kerajaan Persekutuan, dan bukannya tanah.

Tegasnya, syarat baru yang cuba diperkenalkan oleh kerajaan Persekutuan itu tidak selaras dengan semangat perjanjian itu.

"Percanggahan dari perjanjian utama yang cuba dilaksanakan oleh kerajaan Persekutuan akan menyaksikan kerajaan negeri hilang kedaulatan ke atas tanah dan aset air milik Selangor.

"Kedaulatan Selangor adalah nombor satu," kata Azmin pada sidang media di lobi Parlimen hari ini.

hng33. I repeat what I said yesterday. On the ground one week ago, i heard Selangor Gov
wanted to revamp the master Plan. I just don't know how it could be done but now i know.
You have to kill the original plan first on 9 March.

According to news. in original master plan, State agree water assets (pipe) will transfer from concession to Fed and later leaseback to State for operation and maintenance, in return state pay lease fee to Fed for 45 year leaseback period.

But, Fed gov later wan state also transfer not only water asset (pipe) but also land in which pipe lay on to be included in the leaseback agreement. Well, in actual it make no much different, as after 45 year leaseback period, all water assets will be to return back to state gov eventually. Therefore, either pipe as water asset in original agreement or pipe + land in which pipe is lay on is under revise agreement, so long there is no conflict in lease fee, all these water assets be a pipe alone or pipe + land in which pipe lay on, all will be return back to state after 45 year lease period lapse. So, what is different !!?? state just need to enclose term to strictly limit Fed to use such land solely for water pipe purpose. Unless, State now insist that fed need to pay premium on such land and use it as collateral to lower lease fees that need to be pay by state in next 45 year leaseback period.

Kerajaan pusat menyalahkan Selangor kerana “melanggar” perjanjian air sehingga menggagalkan usaha yang dirancang.

Kenyataan ini sama sekali bertentangan dengan pengumuman Menteri Besar Selangor Azmin Ali.

Menteri Tenaga, Teknologi Hijau dan Air Datuk Seri Maximus Ongkili memberitahu Dewan Rakyat bahawa Selangor tidak memenuhi syarat dalam perjanjian yang ditandatangani pada September, untuk membolehkannya berkuat kuasa.

Katanya, segalanya berjalan lancar sehinggalah negeri itu bercadang tidak meneruskan perjanjian.

Selain itu, Kerajaan Persekutuan enggan mengeluarkan Lesen Kemudahan kepada Pengurusan Air Selangor Sdn Bhd (Air Selangor) sebagai pengiktirafan pemilikan ke atas semua baki aset air yang dimiliki pengurusan itu.

“Kerajaan Persekutuan tidak mahu meluluskan pemeteraian Perjanjian Kemudahan dan Sewaan di antara PAAB juga Air Selangor bagi penyewaan aset air yang akan dipindahkan kepada PAAB.

“Mereka juga enggan mengiktiraf pemilikan aset air Selangor berjumlah RM14.9 bilion yang bakal disuntik ke dalam Air Selangor.

“Kerajaan Persekutuan juga enggan mengiktiraf dan menerima pemindahan RM2 bilion dari aset air milik Air Selangor bagi tujuan penyediaan dana kepada pengurusan itu bagi mengambilalih semua konsesi air di negeri ini,” katanya.

Making profit but no dividend to shareholders due to tight cash flow caused by huge account receivables and a result high debt.

hng33. You are wrong in thinking 45 years is nothing--dead wrong. I do construction so i
know the Fed has somethings going ( maybe High Speed Railway ). All the land beside a
highway or public infrastructure will be gone. If water pipe is buried under the land, no
commercial buildings can be constructed but Electric pylon, railway tracts, sewage ponds
Elevated Highway pillars and many many others can be built. Once built the land is gone.
Now Fed have to ask States for Land for every project. Fed has huge list of projects in
Selangor so land is very important

He said the land was not part of the agreement signed between the state government and the Barisan Nasional federal government on September 12, 2014.

The 26,000km of pipes were among the assets listed in the agreement.

"The failure to continue with the master agreement was due to the federal government's refusal to respect the main agreement signed last September.

"They want the land for free, the land does not belong to them. What was stated in the agreement and agreed upon by both sides was to handover the assets owned by the concessionaires.

"If we agreed to that, the state government will lose its sovereignty on the land," he said at a press conference at the Parliament lobby today.

Confident that Selangor residents will support the state's move, Azmin charged that this was part of Putrajaya's move to derail the deal.

He said prior to signing the master agreement, representatives from both Selangor and the federal government had gone through the assets list consisting of pipes, water treatment plants, reservoirs and pump stations with a total value of RM14.9 billion.

He said the state government was willing to renegotiate the deal if Putrajaya acknowledged its sovereignty over land matters and do not make demands that are contrary to the signed master agreement.

The master agreement was signed by Azmin's predecessor Tan Sri Abdul Khalid Ibrahim last year, aimed at taking over operations of the RM30 billion Selangor water industry from four private companies and returning it to public ownership.

The terms of the master agreement include state special-purpose vehicle Pengurusan Air Selangor Sdn Bhd (PASSB) acquiring Syarikat Bekalan Air Selangor Sdn Bhd (Syabas), Puncak Niaga Sdn Bhd (PNSB), Konsortium Abass SDn Bhd (Abass) and services licence-holder Konsortium Air Selangor Sdn Bhd.

Pengurusan Aset Air Bhd (PAAB) will pay RM1.68 billion to facilitate the concession acquisitions and in return, the Selangor government will turn over the water assets to PAAB for a period of 45 years.

PAAB will lease the water assets to PASSB, which will pay a leasing fee to PAAB, at a rate that will be determined between the two parties and set out in the facility and lease agreements.

Azmin yesterday announced that Selangor would not grant Putrajaya a third extension on the Selangor water restructuring deal, which lapsed yesterday, accusing the federal government of breaching the terms of the agreement. – March 10, 2015.

Dakwaan MB S'gor tak betul, kelirukan rakyat, kata menteri

Dakwaan Menteri Besar Mohamed Azmin Ali bahawa kerajaan pusat melanggari perjanjian utama penstrukturan air di Selangor adalah tidak betul dan mengelirukan orang awam.

Menteri Tenaga, Teknologi Hijau dan Air, Datuk Seri Dr Maximus Ongkili, menegaskan bahawa pelanggaran sesuatu perjanjian hanya boleh berlaku apabila perjanjian berkenaan telahpun dikuatkuasakan.

Katanya, sungguhpun perjanjian utama sudah ditandatangani pada 12 September lalu, ia masih belum lagi berkuatkuasa kerana terdapat conditions precedent (CPs) yang belum dipenuhi.

Dear Jacklintan. You have to wait for atleast 3-4 weeks for things to settle down. Right now is all
finger point days--politicians are so damn good at this. You have to understand--Puncak
got the Selangor water deal from Umno (No bid--signed by Khir Toyo former MB). Puncak has
to do what Umno wants --No question ask. If Puncak tries to be funny--Rozali will end up like
Renong boss( lost billions). So just wait for a while- Langat 2 cronies will do the ground work

Energy, Technology and Water Minister Datuk Seri Maximus Ongkili said the Selangor government had yet to resolve issues involving the transfer of assets to the state's special purpose vehicle to manage the restructuring of the water industry.

"Although the master agreement was signed on September 12 last year, it has yet to be enforced because the pre-conditions have not been fulfilled.

"As such, the statement from the Gombak Yang Berhormat that the federal government has contravened the master agreement is incorrect and aimed at confusing the public," he said, referring to Selangor Menteri Besar Mohamed Azmin Ali.

"I want to stress that the contravening of an agreement can only happen when it has been enforced," Ongkili said during Question Time in Parliament today.

The terms of the master agreement include state special-purpose vehicle Pengurusan Air Selangor Sdn Bhd (PASSB) acquiring Syarikat Bekalan Air Selangor Sdn Bhd (Syabas), Puncak Niaga Sdn Bhd (PNSB), Konsortium Abass Sdn Bhd (Abass) and services licence-holder Konsortium Air Selangor Sdn Bhd.

"These issues were to be resolved before November 11 last year but the state government failed to do so until March 9 this year," he said.

He urged Azmin to carry on the "good work" of his predecessor Tan Sri Khalid Ibrahim and his administration.

"Khalid has done a good job. If not, we will leave it to the people of Selangor to decide. We should put people interest above politics, you will suffer if there is not enough water," he added.

Last year, Khalid had signed the master agreement with Ongkili, which would take treatment and distribution operations in the RM30 billion industry out of the hands of three private companies and put them under a state government-controlled entity.

kedaulatan tanah is top-pest priority no 1 in state government, ensuring enough treated water to consumer seem is not a Selangor priority now......

I love to accumulate more Puncak if the knee jerk yet to reach bottom. I'll treated my investment in Puncak as part of my business profile on top of my current retail and trading business

(Remark: instead of expanding further of my current business in future, i've opt to increase my investment in water concession now).

hng: i do not know puncak management background well to be gung-ho on puncak. Would you throw in some light please ? I will need to avg down my holding as well, I am confident with the business but am not so sure if I am confident with the management.

No need to be too serious to involve referendum for the people of Selangor to decide. Just wait if there is water shortage in near future, then, all Selangorean will feel the impact on whether kedaulatan tanah is more important or clean and adequate treated water supply is more important

(MB instead of asking Fed to pay premium for the land that pipe lay on, it straight cancels off the deal, citing to protect kedaulatan tanah !!??

Agree. Business outlook is good but problem is management. If management is good can straight hike water rate like TNB on electricity.

Land part of master agreement in Selangor water deal, says Putrajaya -


Putrajaya did not renege on the Selangor water deal by demanding free land as the provision was already inked in the master agreement, said Energy, Green Technology and Water Minister Datuk Seri Maximus Ongkili.

Contrary to Selangor's accusations, the land was part of the assets stated in the master agreement.

"There are no additional new terms. They did not read the agreement properly. It states that the assets include the land above and below the pipes," he said and proceeded to read part of the agreement to reporters at a press conference at the Parliament lobby today.

If need be, the federal government is willing to lease the land from Selangor, he added.

"We will only lease it for 45 years, we are not permanently taking over the lands."

The federal government therefore did not contravene the spirit and principles of the agreement, the minister said.

Ongkili said Putrajaya had no interests beyond making sure efficient and quality water supply to Klang Valley consumers at reasonable rates, adding that he was worried if the issue had been politicised.
But he remained optimistic that the issue can resolved.

"Let the dust settle first. I will propose to have a meeting with him. I am confident we can still rescue it. If not, I feel sorry for the people of Selangor.

"I know the MB is not easy to deal with, but it can be resolved if you put the people interests first," he said.

Selangor Menteri Besar Mohamed Azmin Ali yesterday announced that Selangor would not grant Putrajaya a third extension on the water restructuring deal, which lapsed yesterday, accusing the federal government of breaching the terms of the agreement.

Earlier today, Azmin said the water deal tanked because Putrajaya wanted free land, particularly where the water pipes was located.

He argued the land was not part of the agreement signed between the state government and the Barisan Nasional federal government on September 12, 2014.

The 26,000km of pipes were among the assets listed in the agreement.

"The failure to continue with the master agreement was due to the federal government's refusal to respect the main agreement signed last September.

"They want the land for free, the land does not belong to them. What was stated in the agreement and agreed upon by both sides was to handover the assets owned by the concessionaires.

"If we agreed to that, the state government will lose its sovereignty on the land," he said at a press conference at the Parliament lobby today.

Last year, Azmin's predecessor Tan Sri Khalid Ibrahim signed the master agreement with Maximus, which would take treatment and distribution operations in the RM30 billion industry out of the hands of three private companies and put them under a state government-controlled entity.
