The extension has been granted twice, I think MB Azmin wanted to give them a wake up call so that Putrajaya will take thing more seriously. Hope everthing will conclude soon.

kqtay, awer is criticizing azmin for politicizing water deal, citing that Selangor water users will have to eventually bear all cost of restructuring and a delay will not benefit them. This should be a wake up call to Azmin, not Putrajaya!

There are already ongoing legal case between Puncak and state gov over its refusal to grant water traffic hike, and seek legal action action against state to compensate Puncak over its outstanding receivable and debt incur.

Therefore, if state allow deal to lapse, despite cannot seal the final deal, Puncak can still use State latest official take over offer document and SPA sign between state and Puncak, in which State now is willing to compensate Puncak equity interest for RM 1.555 bil and absorb all debt. These official and legal SPA document, therefore can used as latest evidence to submit to high court, and expedite current ongoing legal case, and order soon solution in favor to Puncak.

Azmin confusing people, land never part of water deal, Putrajaya says

Selangor was never required to surrender land under the master agreement with Putrajaya on the restructuring of the state's water industry, the Energy, Green Technology and Water Ministry said tonight.

The Selangor government only needed to grant access to the 26,000km of pipes for the federal government's water assets management company to lease back to the state's special purpose vehicle that will manage the water industry, minister Datuk Seri Maximus Ongkili said today.

"The question of the land covering 26,000km of pipes was never a central issue to the implementation of the master agreement.

"The statement by the Selangor mentri besar that the state’s sovereignty is jeopardised because the federal government insists it wants land covering 26,000km of pipe area in Selangor is confusing and worries the rakyat of Selangor," he said.

Ongkili said the ministry is still committed in ensuring the success of the master agreement signed between four parties on the restructuring of the state water supply industry.

The master agreement was signed between the federal government, Selangor government, Pengurusan Aset Air Berhad (PAAB) and Pengurusan Air Selangor Sdn Bhd (Air Selangor) on September 12, last year.

He said the ministry will continue to engage with the state government to resume talks and extend the cut-off date by writing a letter to Azmin asking him to rethink the decision on Thursday.

"The letter also requested for a meeting at the officers' level, as well as between the minister and menteri besar, as soon as possible.”

On the land ownership issue, he said the assets will be leased out to the water services operator (Air Selangor) for 45 years, and once the tenure is completed, the assets and related land will be returned to the state.

He said that although the master agreement has defined water assets to include land, the issue of Selangor having to surrender land covering 26,000km of pipes was never a central issue.

On whether the federal government would invoke Section 114 of the Water Services Industry Act 2006 to resolve the impasse, Ongkili said it is an option but only as a last resort when negotiations fail and national interests are jeopardised.

A legal recourse, he added is also an option as the heads of agreement earlier signed between the parties concerned on August 1, 2014 is irrevocable.

"However, the ministry is confident the federal government and Selangor government can sit down and iron out all disputes towards realising the master agreement." he said. – March 13, 2015.

hng33, while I believe Azmin is the main culprit, Putrajaya has contributed too. Should it be that simple, Putrajaya could have offered alternative long ago, officially or unofficially, during the 3 months. All I can say, damn politicians! We are not as rich as the developed nations, and our politicians are acting like one already. Sigh!

this water company deal look like Taiwan drama over thousands episode still haven't end . But this time hopefully they will done the deal . I don't want when 2017 I have to bath in drain . . We want stabil water supply and also a good return in my puncak investment . I wish that after puncak done then can switch my capital to kps waiting for another round of earnings . .

Stockman you are wrong. Azmin & Anwar want to put PKR cronies in Langat 2 and
All highway projects. With cronies you get money. With money you can fight 14 Election on
a balance platform. Khalid actually KIlled KPS initiatives for controlling Langat 2 (taliworks to
control pippings) Anwar knew Khalid's hand is tied by huge loan taken from Bank Islam(18m)
so he kicked him out.
The whole restructuring is about making money ( from selangor ppl) Langat 2 will increase
water rate 2-3 times more while flooding is occurring weekly in Selangor. We have
more rain water than we need and real culprit is Management and leaky pipes

if 2017 no water, property value(especially condominium) in selangor will drop . This will cause the bank will collapse. The whole country will kaput.

Those house value that sit next to river will shoot-up like rocket as they can build a "jamban" next to the river to discharge their waste.

Kelantan will be the capital of malaysia as this state have the most water until flooded.

Will last minute extension request breathe new life into water deal?

AS the Selangor water industry restructuring saga continues on a daily basis, it comes down to one pertinent question: Will Selangor lose its sovereignty over the land lease agreement with the federal government?

The restructuring of the Selangor water deadlock was supposed to reach a significant milestone in mid-January with the biggest water concessionaire in the state, Puncak Niaga Holdings Bhd, controlled by Malaysia’s 40th richest tycoon Tan Sri Rozali Ismail, handing over its water business to Selangor’s PKR-controlled government. That hit a snag over the land issue and the much anticipated completion of the Selangor water deal was extended twice until it lapsed on March 9 that sparked heated arguments between both governments.

But at the eleventh hour yesterday, Pengurusan Air Selangor Sdn Bhd (Air Selangor) – Selangor government entity created late last year to facilitate the takeover – has relented to give in for a third extension request expiring on April 9, according to Puncak Niaga’s latest filing with Bursa Malaysia. Puncak Niaga is deliberating on the request.

This is an unexpected move by the state as it was vocal on not seeking another extension. This may prevent a court battle for the time being but the contention matters remain and both parties are now in the spotlight.

An observer familiar with the matter tells StarBizWeek that the disagreement is on the terms used involving state land that the water assets, mainly pipes and treatment plants, are on.

Those assets were to be handed over to the federal government in return for the RM2bil cash for Air Selangor to fund the RM9.6bil acquisition of the four concessionaires.

And out of the RM2bil cash extended, RM1.68bil has been utilised by Air Selangor to take over the water concession businesses of Puncak Niaga Sdn Bhd (PNSB), Syarikat Bekalan Air Selangor Sdn Bhd (Syabas) and Konsortium ABASS. Only Syarikat Pengeluar Air Selangor Sdn Bhd (Splash) which is 40% controlled by construction giant Gamuda Bhd, with the remainder 60% equally divided between Tan Sri Wan Azmi Wan Hamzah and the Selangor state via its vehicle Kumpulan Perangsang Selangor Bhd, is still pending due to valuation disagreement.

“The land lease agreement for 45 years and outright acquisition are two different things. This disagreement should be put in the right perspective where long-winded court battle should be avoided as the capital and Selangor as the most industrialised state in Malaysia, are in a dire situation to improve their water supply pipes and raw water treatment capacity,” he says.

The observer also suggests the state and federal governments look into other avenues, in terms of repayment or collateral, for the RM2bil aid.

“If the lease is considered an acquisition, both must move on. I don’t think there is an issue if the Government’s water asset sits on state land or vice versa,” he says.

Since it started in 2009, capex to improve old water pipes and water treatment facilities has been frozen pending an amicable agreement involving water concessionaires, the Selangor government and Putrajaya,

The observer also points out as this prolonged battle beats the purpose of Water Services and Industries Act (WSIA) that generally aims to provide efficient services and better quality water supply, regulated water services industry, relieve Federal government obligation to provide funding to states and relieve state governments of the heavy financial burden to develop water assets.

Selangor earlier this week (before the third extension was public) had expressed intention to revoke the water agreement with Putrajaya that was inked by previous Selangor mentri besar Tan Sri Abdul Khalid Ibrahim in September last year.

This is because Mentri Besar Azmin Ali alleges that the federal government did not comply with conditions set by the state government.

“They (the federal government) breached the agreement and did not honour it” is one of Azmin’s quotes that was splashed in the news over the past couple of days.

Azmin reasons that Putrajaya’s request for the land where water pipes will be laid will result in Selangor giving up sovereignty over its land. cont...............

On the other side, Energy, Green Technology and Water Minister Datuk Seri Maximus Ongkili points out that the land is only to be leased for 45 years, while his deputy Datuk Seri Mahdzir Khalid adds that the land is meant to be collateral for the RM2bil extended.

Besides this, there are still three matters that need to be ironed out for the master agreement to be effective. The first surrounds the transfer of water assets and land to Pengurusan Aset Air Bhd (PAAB) in return for RM1.68bil cash and assumption of liabilities.

The second is on the application of a facility licence from the regulator but it should not include water assets in Federal Territory and Putrajaya, particularly the Bukit Nenas, Semenyih and Wangsa Maju treatment plants, which Ongkili says belong to the federal government.

The last is for Air Selangor to provide a financial model to PAAB, the water asset management company formed by the Government, and the regulators.

As of yesterday, Azmin plans to seek Prime Minister Datuk Seri Najib Tun Razak’s advice on this matter and negotiations should resume next week.

Water is essential

The 7.5 million people in Selangor and the Klang Valley are well aware and have had their share of frequent water rationings. Most households in the capital are equipped with water filters, a sign that the quality of the distribution network of treated water supply should be improved.

Of the 130,000km of pipes in Malaysia, a third are made from asbestos cement, which has been known to cause cancer.

Syabas, which is responsible for water distribution in the Klang Valley and Selangor, says about 25% of the total 25, 650 km of its pipelines need to be replaced as they were installed more than 50 years ago.

Syabas could not replace the leaky pipes due to a freeze in capex. The porous pipes are the main culprit for non-revenue water (NRW), which is at a staggering 36.6% or 5.69 billion litres a day.

The average cost of replacing 1km of pipe is about RM1mil and Syabas has 6,412km of old pipes that need urgent attention.

Last year, about 2.4 million people in Selangor and Kuala Lumpur suffered from the worst water supply cut and rationing since 1998 due to a dry spell aggravated by the limited capacity of treatment plants which has not been upgraded due to the impending water restructuring. Expectations are that there will be further rationing of water. The Sungai Selangor dam which services about half of the Klang Valley and Selangor population is currently 74% full but it will dry up quickly due to the expected El Nino.

Consumers are not the only victims. Businesses are also affected by the cuts in water supply.

Today my insider ask me to follow him to sungai selangor dam that belong the splash and check the water level over there. The water storage is only 70% of the total dam capacity. Everyday drop.

my insider also told me that something will happen in April . Faster buy all water stock. Another water rationing going to happen. Also , faster buy some plastic drums to store water. Explosion coming.

my insider last year january 2014 also told me to follow him to check on sungai selangor dam and during the time is also 70%, Then after that i also gave tips to the forum to buy water stock. All the water stock fired-up like rocket during the water rationing in mar 14.

KUALA LUMPUR (Mar 14): Syarikat Bekalan Air Selangor Sdn Bhd (SYABAS) said that the unresolved water restructuring issue has serious economic implications, due to the delay of a number of projects, including the Langat 2 project.

In a statement, Tan Sri Rozali Ismail, executive chairman of SYABAS and Puncak Niaga Holdings Bhd (PNHB) (Financial Dashboard), said the postponing of these projects has resulted in the foregoing of supply of a total 850.82 million litres of water to 1,038 new developments.

"The postponing of these big projects involves billions of ringgit in investment, and will definitely impact the economic growth of the country, and have also resulted in the loss of employment opportunities in Selangor, Kuala Lumpur and Putrajaya," said Rozali.

To recap, PNHB had agreed to sell its unit Puncak Niaga (M) Sdn Bhd and its 70%-owned SYABAS to Pengurusan Air Selangor Sdn Bhd for RM1.55 billion on Nov 11, 2014.

Following the sale of water assets, PNHB shareholders are also expected to receive a special dividend of RM1 per share, which translates to a 37% dividend yield.

However, the transfer of water assets had been extended three times to March 9, 2015, due to the non-fulfillment of the conditions precedent stated in the conditional sale and purchase agreement.

Last Monday, Selangor Menteri Besar Mohamed Azmin Ali said that no further extension would be granted for the agreement which lapsed on the same day.

rich, I am no politician, but guess anyone sacked won't mind saying what Khalid had just said at this moment. I just feel good knowing someone slapping Azmin's face. If Azmin could have mentioned earlier the land issue, I would not have been so furious. Given that he did it only last week and yet have a change of heart (?) through a letter seeking delay is even more shameful!

Personally, I believe Khalid should have resigned when he is not in favored by PR to rule Selangor, being sacked when declining to step down is inevitable.

jolie, if azmin is to only trying to clean the left-over shit, he should state clearly at the beginning the viability of the transaction upon his appointment as MB, instead of the other way round. Should he find the land deal not appropriate, he should have stated it clearly at the end of first deadline. I remember clearly that he blamed Puncak for the delay at the end of first deadline! On last Monday, he said the deal will not be completed, yet on Friday, Air Selangor (a subsidiary of Selangor state in charge of the water deal) requested another 1 month delay from Puncak. Azmin is clearly mishandling the water issue right now, and he should apologize not only Selangor people, but shareholders of listed companies affected by his reckless speech.

水务整合恐告吹
目前另一单收购计划,迟的不是几天,而是几个月,甚至是要告吹了。那就是雪兰莪的水务整合计划。
众所皆知,整个计划因为州政府和中央政府的不咬弦,阻碍重重。其中,商峰(PUNCAK)更是高调的认为,州政府出价太低,无意妥协。

根据2014年12月31日的业绩报告,公司净资产已从4.60令吉,增加到5.02令吉;而9个月后的现在,其股权价值肯定只有增加,之前的20至30%折扣(售价15.5亿令吉)也已不适用。公司应该采取27亿令吉加上这9个月的业务发展来衡量。

因此,下次重新议价,肯定只有祭出更高的价钱才能让股东心动。别忘记这是特许经营权,商峰在政府争议不断期间提供了服务,费用是每个月照收的,不可能白做吧。
拜读巴菲特的给股东信,可从中读到他有一些很好的收购计划,因为议价不合而谈不拢,之后他得要付出更高的代价来弥补所犯下的错误。因此,这回如果让高峰卖不成手上的金鹅,股东几经反省,得到以下的结论:之后政府一定要付出更高的代价,来为错过这次黄金机会埋单。

It seem generally no much different between latest media release compared with previous release..............but in actual, there is BIG different now....

In the latest media release, it highlighted two top post in fed gov and state gov, YAB Prime Minister of Msia + YAB Dato Menteri Besar of Selangor will to put in their best effort and to work closely and resolve the matter. These are the highest ranking in both Fed and State, all thing will be able to settle at these highest level already
