April 30 Deadline For Selangor Water Restructuring Extension

KUALA LUMPUR, April 2 (Bernama) -- The Selangor government has up to April 30 to respond on extending the cut-off date for the Master Agreement on the Selangor water supply industry restructuring, said Energy, Green Technology and Water Minister Datuk Seri Dr Maximus Ongkili today.

Failing this, he said, the Federal Government would take the view that the Selangor government was not interested to take up the offer on the restructuring exercise and complete takeover of the concessionaires in Selangor as contained in the Master Agreement.

He said after the deadline, the Federal government would take the necessary action required under the Water Services Industry Act 2008 (WSIA) and other relevant laws to ensure the national interest and welfare of the people were protected.

"To ensure the security of water supply and completion of all planned projects including mitigation measures, we are hopeful that the spirit of cooperation as upheld by the Selangor Government in the past will continue to prevail," he said after visiting the Langat 2 Water Treatment Plant in Hulu Langat near here.

Ongkili said the cut-off date for the Master Agreement had been extended twice as it lapsed on March 9 but the Selangor government did not agree to extend it further to complete the Master Agreement's implementation.

"I have even personally written to Selangor Menteri Besar Azmin Ali on March 12 asking him to rethink his decision not to extend the cut-off date of the Master Agreemen as well as on outstanding matters that need to be resolved. However to date, I have not received a formal reply from the Menteri Besar," he said.

Ongkili said the federal government valued very much the royal address by the Sultan of Selangor, Sultan Sharafuddin Idris Shah at the opening of the state legislative assembly sitting on March 30, in which he expressed concern on the impact of all the delays and politicking to the lives of people of Selangor, Kuala Lumpur and Putrajaya as well as on business.

"We hope the Selangor Government will take heed of His Highness' advice thatt he Master Agreement is implemented fully and ensure security of water supply as planned," he said.

Ongkili said his ministry maintained that the parties involved should respect and adhere to the contents of the Master Agreement.

"There are points in the agreement that require fine-tuning to the satisfaction of both parties," he said, adding that the matters were pertaining to land and other water assets, which had already been agreed during discussions and negotiations in the crafting of the Master Agreement.

"We have not changed the goal posts nor added any new items in the agreement All the Selangor Government needs to do is to comply to the terms," he said.

Specifically, he said, they continued to claim that the land on which the Bukit Nenas and Semenyih plants sit belong to Selangor, which by law was a baseless claim.

Ongkili said the matters needed to be sorted out otherwise the Master Agreement would collapse and the Federal Government would have to revert to other options including legal recourse to exercise its right.

Discussions in the last two years have facilitated the signing of a memorandum of understanding (MoU) on Selangor water rstructuring on Feb 26 last year, a heads of agreement (HoA) on Aug 1 and finally the Master Agreement on Sept 2.

The head of agreement is irrevocable, if State insist not to sign master agreement, then legal action can be taken against state and more importantly, Wasia will enforce and it empower Fed to take over all water asset operation. State will total lose all control over water asset and under Wasia, Fed can direct deal with all water concession holder, bypass state gov. Azmi if wise, will need to rethink seriously, either wan to politicizing water issue for personal gain or risk to lose opptunity for state to regain state water assets operation, face legal action from Fed and allowing Wasia to first enforce in state.

rich: Kenanga TP RM3.99 is about adding back special dividend to current depree share price which already fully at discount to special dividend.

Wost case scenario is Wasia and court case....by the time, this is settle, Selangor will be completely dry without water. Industry will be backly impacted and so is the people. Guess peoplewill starts to dig well as this case goes to court.

Legal action need take time, but Wasia can be enforce immediately to protect national interest, Fed will take over all water asset operation, by pass state gov, Fed can direct deal with concession, langat 2 can be proceed as plan.

Therefore, if Azmin refuse to sign master agreement by end of these month, the worse is on state itself. With Wasia, Fed is in power on state water assets.

Hence, any rational MB will not risk itself to lose own power on water asset, compromise deal will be a final solution to seal the deal.

Ini juga termasuk meningkatan hasil tanaman padi serta perluasan sistem pengangkutan.

Selangor Menteri Besar Mohamed Azmin Ali will meet Energy, Green Technology and Water Minister Datuk Seri Dr Maximus Ongkili next week to discuss Selangor's water supply industry restructuring.

Azmin said state government officers headed by the state secretary had held discussions on the matter two weeks ago.

"The state government really wants this and we welcome the federal government's intention to continue negotiations, provided that it must comply with the terms and conditions of the original agreement," he said in Klang today.

After discussions between Selangor and Putrajaya on March 23, Ongkili said the agreement terms to restructure the state water industry remained the same.

On the status of two land assets in Bukit Nanas and Semenyih involved in the master agreement, Ongkili said it would be determined after further discussions between the two parties.

The Selangor government on Tuesday said that the federal government was trying to take over the entire 26,000km of water pipe assets including land even though it contradicted the master agreement on the water restructuring exercise.

Azmin said that as a result of the action by the federal government, Selangor had called off the restructuring deal signed on September 12, 2014 before they agreed to renegotiate on March 23.

KLANG, 4 APR: Jawapan rasmi kepada Putrajaya berhubung tempoh lanjutan tarikh akhir perjanjian induk penstrukturan semula industri air Selangor akan diserahkan Isnin ini.

Sebelum itu, beliau dijemput merasmikan Konvensyen Falak Selangor 2015 di Masjid Tengku Ampuan Jemaah, Bukit Jelutong, Shah Alam.

Di majlis tersebut, Mohamed Azmin berkata perbincangan terpaksa ditangguhgkan berikutan fokus kini tertumpu kepada sidang Dewan Negeri Selangor (DNS) yang sedang berlangsung.

“Ya, walaupun saya belum jawab secara rasmi (surat menteri) tetapi perbincangan telah pun bermula di peringkat pegawai lebih kurang dua minggu lepas di mana Setiausaha Kerajaan Negeri (SUK) sendiri mengetuai delegasi Kerajaan Negeri bertemu dengan ketua setiausaha.

Terdahulu, Kerajaan Selangor diberi masa hingga 30 April ini untuk memberi jawapan tentang pelanjutan tarikh akhir bagi Perjanjian Induk mengenai penstrukturan semula industri bekalan air Selangor.

Sekiranya gagal berbuat demikian, Kerajaan Persekutuan akan menganggap bahawa Kerajaan Selangor tidak berminat menerima tawaran mengenai langkah penyusunan semula itu dan pengambilalihan penuh pemegang konsesi di Selangor seperti yang terkandung dalam Perjanjian Induk.

Saya mengucapkan terima kasih kepada Dato' Menteri Besar Selangor kerana memberi respon terhadap sesetengah isu yang saya bangkitkan meskipun jawapan beliau lebih kepada cubaan untuk memperlekehkan legasi saya selaku mantan menteri besar.

Apatah lagi isu yang sangat penting yakni penstrukturan semula industri air tidak disentuh sama sekali.

Sesungguhnya, rakyat Selangor berhak mendapat penjelasan dan kepastian terutama tentang komitmen beliau dalam memuktamadkan segera penyusunan semula industri air pada kos keseluruhan tidak melebihi RM9.65 bilion; langkah-langkah mengambilalih Splash, satu-satunya syarikat konsesi yang masih berdegil dan penamatan serta-merta perjanjian penswastaan berat sebelah dengan semua syarikat konsesi.

Kita semua, lebih-lebih lagi pemimpin, sepatutnya tahu ada perbezaan yang besar antara keberanian melulu dan kebijaksanaan terpimpin dalam membuat keputusan.

Apa gunanya berani persis panglima perang sekiranya strategi dan teknik yang digunapakai bakal menyebabkan kita menang satu pertempuran tapi kalah di dalam peperangan.

I guess the meeting between Azmi and Ongkili should be by 9 April, mean within these 3 days. After discussion, it may need some time to conclude the deal. Therefore it could be likely further extension after 9 April. Azmi took excuse current state legislative assembly as reason for the delay.
